Essential to a Proper Understanding of Federalism.......2004-03-16
All too often, laymen and lawyers alike wrongly refer to federalism as a synonym for "states' rights." Some think it simply a tool in the "conservative" constitutional scholar's arsenal. This reviewer is an attorney who was once a student of Professor David Engdahl, and I can assure you that neither he nor his scholarship supports either of those erroneous notions. Those who have respect for complexity and nuance will have much to appreciate here.
Nonetheless, Engdahl rejects the notion of "process federalism," a dubious notion that really isn't federalism at all. He provides a clear overview of the concept of enumerated powers, discussing what is actually meant by the word "powers" in this sense, and also how those powers extend in legislation. His discussion of the Necessary and Proper Clause is as sophisticated as any in the legal academy. Likewise, his understanding of the Commerce Clause is much more logical and textually supportable than those exhibited by any of the justices on the U.S. Supreme Court. Engdahl is also an expert on interstate compacts and federal borrowing and spending powers, giving readers of this work with some impressive scholarship in these areas. He also provides a much better approach to the commandeering immunity concept, as grounded in the Necessary and Proper Clause (rather than the 10th Amendment), and rightly identifies the Ex Parte Young doctrine (a part of 11th Amendment jurisprudence) as a "silly fiction."
As noted, this book is written in the form of a small treatise, so it is not something a layperson would pick up and as easily understand. Furthermore, this edition was printed in 1987, and there have been many developments since that time, largely in the guise of the "New Federalism" spawned by U.S. v. Lopez (1995) and recent jurisprudence in the area of state sovereign immunity. (This reviewer recommends Dr. Michael Greve's "Real Federalism" for a discussion of more recent federalism jurisprudence.) None of the more recent developments detract from what is contained in this book, however. This small treatise provides the law students and legal scholars with clear and well-reasoned analysis of the principles of federalism and Supreme Court jurisprudence in that area. It is highly recommended.

However, after reading the first novel in the anthology, Chaereas and Callirhoe, I was hooked. These ancient novels are wonderful works of literature, written in a readable style that will grip anyone who reads them. I think also, that there is no better way to get in touch with Hellenistic history than to read a contemporary source.
The Remnants of a Genre.......2000-04-26
The core of the book consists of five "novels" - all from the 2nd century A.D., give or take a hundred or so years - that share enough conventions to be labeled a "genre". Their plots, in broadest outline, are identical: Boy and girl meet, fall in love, are married or about to be married, then are snatched apart by misfortune, faced with escalating threats to life and chastity, and finally reunited with virtue intact (hers anyway - his may wind up a bit tattered).
Within this pattern, there is much variation. "An Ephesian Tale" is sheer melodrama, "Chaereas and Callirhoe" a loosely historical romance, "An Ethiopian Story" a skillful narrative that opens with a trompe l'oeil scene that would do credit to a contemporary novelist. Perhaps the most interesting to the modern reader is "Daphnis and Chloe", where the perils to the lovers are more psychological than physical and the story traces their love affair from the first stirrings of adolescent attraction through long-delayed consummation.
Also present are works in other genres: a bawdy comedy ("The Ass", wrongly attributed in the Middle Ages to Lucian), a Munchausen-like travelogue (the authentic Lucian's "True Romance") and the faux historical "Alexander Romance", which shaped the later image of Alexander the Great as much as or more than did genuine history.
The translations, all but one specially prepared for this volume, are readable and generally lively. Only one of translators (burdened with the rather hopeless "Leucippe and Clitophon", in which he labors to uncover deeply hidden virtues) feels compelled to preface his effort with a discourse on literary theory.
The narratives gathered here are little-traveled paths in the terrain of classical literature and the reader may stumble now and then among the brambles, but the sights along the way are not without interest and charm.

In 1997, amid much fanfare, Leo Corry announced to the world that he had uncovered proof that Albert Einstein arrived at the generally covariant field equations of gravitation, before David Hilbert. Leo Corry joined with Juergen Renn and John Stachel and published an article in the journal "Science" arguing against Hilbert's priority. Their claims were largely based on a set of printer's proofs of David Hilbert's 20 November 1915 Goettingen lecture, which Corry had uncovered. However, in this 1997 article, "Belated Decision in the Hilbert-Einstein Priority Dispute," Corry, Renn and Stachel failed to disclose the fact that these printer's proofs were mutilated, and are missing a critical part. Full disclosure of the facts reveals that even in their mutilated state, these proofs prove that Hilbert had a generally covariant theory of gravitation before Einstein, and that Einstein plagiarized these equations from Hilbert. The author of "Albert Einstein: The Incorrigible Plagiarist" focuses in on the general theory of relativity and discredits the baseless historical revisionism of Leo Corry, Juergen Renn and John Stachel. The direct comparison of primary source material demonstrates that Albert Einstein did not originate the theory of relativity. Formal mathematical proofs explain how Einstein was forced to fudge his equations in order to derive the results Paul Gerber and Johann Georg von Soldner had published long before him. Einstein did not yet have the benefit of plagiarizing David Hilbert's generally covariant field equations of gravitation and was operating under an erroneous assumption. An extensive history of the principle of equivalence proves that Einstein plagiarized this idea. The book reprints the relevant papers by Einstein, Soldner, Gerber, and Hilbert, as well as the remainder of David Hilbert's mutilated printer's proofs of his article "The Foundations of Physics". While the book presents the mathematical proofs needed to justify its claims, the non-mathematical reader will find it rich in prose and will be able to follow the arguments and the history presented.Customer Reviews:
