Saved by the Southern *itch!.......2006-11-24
Phillips isn't really the "B" word. Instead, she's a wise Southern woman who knows how to pack a punch with professionalism, grace and humor. Anyone who has ever had a problem with a product or service - no matter how insignificant or horrendous - will be best served by Phillips' advice. "And the truth shall make you free!"
The best Christmas gift received.......2004-01-01
I do love a good read. One of my favorite gifts was the set of Ellen Phillips's "consumer empowerment" books. I actually began reading Fight Back and Win first as I knew it had a large section on senior/elderly issues. Even if I never write a complaint letter, I now own a valuable resource that tells me anything I want to know or how to find it out. The author is amazing. She doesn't condesend to us older people, and her sense of humor helps when discussing some of the self-help promotions that often make me feel ill-at-ease with younger so-called experts.
Of course if and when I get reday to write any sort of complaint letter, she shows me just how to do it to get the desired results. I can't thank Ms. Phillips enough (nor my daughter-in-law who gifted me with these wonderful books).
A Painless Way to Get Action on Consumer Issues.......2003-04-24
The author of "Fight Back and Win" has done the research that most of us wish we had the time to do in order to get action on our complaints. Ms. Phillips has included many examples of letters that are succinct and easily edited to pertain to a variety of consumer complaint situations. At the end of each letter she has listed real names and state consumer protection agencies that one can contact or send carbon copies of the complaint letter. Even better, at the end of each chapter, she lists various organizations and websites tailored to each type of letter.
I myself used her book to quickly write a letter of my own that got a response within a week and the repair I sought completed within two weeks. This book truly can help consumers to "Fight Back and Win".
Fight Back and Win.......2003-03-26
I actually put to use the book Fight Back and Win, by Ellen Phillips, and had great success! I had a travel problem with Delta Airlines and after reading Ms. Phillips's book I wrote them a letter. I was totally amazed how fast I received a response. I knew after reading her first book, Shocked, Appalled, and Dismayed, that between the two books I had all the facts and information I would need to write the appropriate letter to a big business. I honestly recommend this book as a useful book that will be helpful and not put on your bookshelf to collect dust!!!!
A Must Have For The Savy Consumer.......2003-02-02
FIGHT BACK AND WIN is an important resource for the savy consumer and the client centered organization. Highly readible and entertaining, it gives concrete advice on a variety of contemporary problems. Most important it provides the tools for individuals to successfully obtain what they want. Empowerment plus!

Book Description
Three questions concerning modern legal thought provide the framework for It’s All in the Game: What should judges do? What do judges do? What can judges do? Contrasting his own answers to traditional responses and moving playfully between debates of high theory, daily practices of appellate judges, and his own enlightening analyses of significant court rulings, Allan C. Hutchinson examines what it means to treat adjudication as an engaged game of rhetorical justification. His resulting argument enables the reader to grasp more fully the practical operation, political determinants, and the transformative possibilities of law and adjudication.
Taking on leading contemporary theories to explore the claim that “law is politics,” Hutchinson delineates a route toward professional, relevant, and responsible—if radical—judicial practices. After discussing the difference between foundationalist, antifoundationalist, and nonfoundationalist legal critiques, he offers a focused, unequivocal, and positive account of the advantages of operating within a nonfoundationalist framework. Although such an approach centralizes the role of rhetoric in law, Hutchinson claims that this does not necessitate a turn away from politics or, more particularly, from a progressive politics. Driving home the political and jurisprudential impact of his critique and of his account of nonfoundationalist alternatives, he urges judges and jurists to engage in law’s language game of politics.
This engaging book will interest linguistic philosophers, legal theorists, law students, attorneys, judges, and jurists of all stripes.
Book Description
Ordinary Americans often bring family and neighborhood problems to court, seeking justice or revenge. The litigants in these local squabbles encounter law at its boundaries in the corridors of busy city courthouses, in the offices of court clerks, and in the church parlors used by mediation programs.
Getting Justice and Getting Even concerns the legal consciousness of working class Americans and their experiences with court and mediation. Following cases into and through the courts, Sally Engle Merry provides an ethnographic study of local law and of the people who use it in a New England city. The litigants, primarily white, native-born, and working class, go to court because as part of mainstream America they feel entitled to use its legal system. Although neither powerful nor highly educated, they expect the law's support when they face intolerable infringements of their rights, privacy, and safety. Yet as personal problems enter the legal system and move through mediation sessions, clerk's hearings, and prosecutor's conferences, the citizen plaintiff rapidly loses control of the process. Court officials and mediators interpret and characterize the meaning of these experiences, reframing and categorizing them in different discourses. Some plaintiffs yield to these interpretations, but others resist, struggling to assert their own version of the problem.
Ultimately, Merry exposes the paradox of legal entitlement. While going to court allows an individual to dominate domestic relationships, the litigant must increasingly yield control of the situation to the court that supplies that power.
Book Description
This book examines theories of language for their contribution to understanding the interpretation of constitutional law by the Supreme Court.
Book Description
A study that will appeal to any reader interested in the relationship between our language and our laws, Ideology in the Language of Judges focuses on the way judges take guilty pleas from criminal defendants and on the judges' views of their own courtroom behavior. This book argues that variation in the discourse structure of the guilty pleas can best be understood as enactments of the judges' differing interpretations of due process law and the proper role of the judge in the courtroom. Susan Philips demonstrates how legal and professional ideologies are expressed differently in interviews and socially occurring speech, and reveals how bounded written and spoken genres of legal discourse play a role in containing and ordering ideological diversity in language use. She also shows how the ideological struggles in a given courtroom are central yet largely hidden or denied. Such findings will contribute significantly to the study of how speakers create realities through their use of language.

A recent volume of this series (
Signals and Signal Transduction
Pathways in Plants (K. Palme, ed.)
Plant Molecular Biology
26, 1237-1679) described the relay races by which signals are transported in plants from the sites of stimuli to the gene expression machinery of the cell. Part of this machinery, the transcription apparatus, has been well studied in the last two decades, and many important mechanisms controlling gene expression at the transcriptional level have been elucidated. However, control of gene expression is by no means complete once the RNA has been produced. Important regulatory devices determine the maturation and usage of mRNA and the fate of its translation product. Post-transcriptional regulation is especially important for generating a fast response to environmental and intracellular signals. This book summarizes recent progress in the area of post-transcriptional regulation of gene expression in plants. 18 chapters of the book address problems of RNA processing and stability, regulation of translation, protein folding and degradation, as well as intracellular and cell-to-cell transport of proteins and nucleic acids. Several chapters are devoted to the processes taking place in plant organelles.
Book Description
The last ten years have witnessed a remarkable increase in our awareness of the importance of events subsequent to transcriptional initiation in terms of the regulation and control of gene expression. In particular, the development of recombinant DNA techniques begun in the 1970s provided powerful new tools with which to study the molecular basis of control and regulation at all lev- els. This up-to-date guide discusses the post-transcriptional processes controlling and regulating gene expression in eucaryotes and procaryotes. The topics covered include transcriptional (anti)termination, mRNA stability, anti-sense RNA, translational control and translational fidelity. An understanding of these mechanisms is an essential requirement for the optimisation of gene expression in various biotechnological applications.

Book Description
-- Url Lanham, Professor of Natural History and Curator in the Museum, University of Colorado
How does bison meat taste after being frozen for 30,000 years? Were Ice Age cave painters trying to create "art" or just record history? How did ancient oil spills occur, before there were oil companies to create them? Those are just some of the questions renowned paleontologist Bjorn Kurten answers in this collection of lighthearted essays on fossils, ancient life, and related topics. Written for the general reader, these lively pieces range from a look at how scientific theories are created to some new views of old myths. Among the topics Kurten examines are the history of the Mediterranean Sea, the origin of birds, the theory of plate tectonics (continental drift), and the discovery of Piltdown Man, the "missing link" fossil forgery that fooled scientists for more than 40 years.
And, true to its title, the book offers a humorous "recipe" for freezing a mammoth that is tundra-tested, if not totally foolproof. "You may have to expend a few hundred mammoths before everything works out," the reader is cautioned, "But there are plenty of them." (Although the author hasn't tasted the fruits of his mammoth recipe, he did feast on some ancient bison meat that dated from 30,000 years ago. Kurten described the taste as "agreeable.")
Throughout these essays Kurten brings the prehistoric world alive with enthusiasm and humor, emphasizing that paleontology is the study of those that lived long ago instead of those who are long dead. As he says, "Isn't it more fun to see a dinosaur as something that used to live, rather than as the monstrous heap of bones which it happens to be at present?"
Customer Reviews:
Great collection of popular science essays .......2005-05-26
_How To Deep-Freeze a Mammoth_ by Bjorn Kurten is a collection of fourteen essays of about four to ten pages each. Most of the essays in the book were originally published in a Swedish version, which were then translated by Erik H. Friis, and then rewritten, updated, and expanded for this book by the author (the Swedish version is copyright 1981, while this work is copyright 1986). A number of black and white drawings by Hubert Pepper accompany the book. The book is 117 pages long and was a quick read; I read it in a day.
A rather enjoyable, for the most part easy to read book, the first four essays dealt with the author's opinions about the world of science as a whole, contrasting it with the world of pseudoscience. Along the way Kurten attacked some of the more egregious examples of pseudoscience, such as several Nazi "scientists", the Soviet "geneticist" Trofim Lysenko, Creationism (which he dealt with only very briefly), and the Swedish writer Ivan Troeng, who wrote a book claiming that the moon originated in the Pacific Ocean 11,800 years ago as a result of collision between the Earth and a smaller celestial body. Kurten disliked the fact that pseudoscientists point to individuals who truly revolutionized their fields, like Darwin, Mendel, and Galileo, and when the pseudoscientists offer their revolutionary ideas and are rejected by mainstream science, claim that they are being persecuted just as these individuals were (Kurten asserted that simply so much more is known that a true and utter revolution is just not possible anymore). Additionally, Kurten pointed out that the pseudoscientist sets out to prove something; he or she has a preconceived notion of what really exists, and unlike a real scientist his or her mind is closed to alternative possibilities. By way of contrast Kurten provided an example of a successful revolution, of a theory that was met with a lot of skepticism at first but was later accepted, that of plate tectonics.
The remaining chapters dealt more specifically with issues and ideas in paleontology, with essays on the geological and paleontological history of the Mediterranean Sea (which I thought was a bit too brief), ancient natural oil spills, the science and politics of _Archaeopteryx_, the process whereby mammoths and other Pleistocene mammals were preserved more or less intact, and the first Europeans (I found that chapter a bit technical).
One of my favorite chapters dealt with an unusual 20 million year old fossil, that of a Miocene rhinoceros of the genus _Diceratherium_, discovered in 1935 in Grant County, Washington state. The fossil was found by hikers, who thought at first that they had found a very odd cave with some bone fragments. Upon investigation it was discovered that the cave was a mold of an extinct rhinoceros, one apparently formed when flowing lava engulfed the (apparently bloated) carcass of the animal, a mold not unlike those found at Pompeii. Kurten discussed how the lava was able to preserve this form without igniting the body and what was learned from the fossil (the wrinkles and folds of the skin were even preserved).
Another chapter I enjoyed was one on Piltdown Man, without a doubt the most famous forgery in the history of paleontology (if not science as a whole). Not particularly familiar with this history of this controversy, it was interesting to learn that even when the fossil was first produced it was not immediately accepted. "Dualists" believed that the braincase belong to a man and the lower jaw to that of an ape, while "monists," who believed it, pointed out that no anthropoid ape was known from Pleistocene Europe and that teeth were worn down in the same way as found in humans. Even after the famous second Piltdown "discovery" ("Piltdown II") and before the specimen was dated using fluorine content, there were problems accepting the Piltdown Man as real; originally it was thought in hominids that the brain evolved first, then the teeth and jaws, but instead _Australopithecus_ proved that this was just the opposite, that it had human-like teeth but a brain closer to that of an ape. Piltdown Man just didn't fit in. Kurten in the end debunked every find associated with Piltdown Man, even the idea that the fossils could have been found there in the first place; it was later shown that the chemical properties of the Piltdown gravel were not conducive to fossil formation and preservation.
Another interesting chapter dealt with Neandertals. Kurten speculated that the prominent eyebrow ridges had evolved to give the Neandertals an intimidating glare, a threatening glance to frighten other organisms, a feature not unlike the false eyes developed by some defenseless animals such as several butterfly species.
The chapter on cave art was excellent and was accompanied by a number of illustrations. Kurten mentioned in passing that the larva of a gadfly is one of the animals found represented in a particular cave; a small figurine made from jet of a larvae was discovered. This may have represented one of the animals eaten by man at the time, as these larvae, which are found inside the skin of reindeer, are a delicacy among modern Inuit. Kurten discussed the role cave art played and discussed their possible religious and magical purposes (briefly mentioning that the term cave art may be a misnomer, that likely the late Pleistocene landscape was "studded with pictures" not unlike highway billboards, with art placed on rock walls, tree trunks, and boulders). Kurten favored the notion that it may have been used for instructional purpose for children, noting that the animals were often rendered with very precise detail, so precise that it took zoologists to notice it (for instance animals clearly in heat were depicted), and that it was produced for its own enjoyment (noting the many very erotic depictions of women, something generally passed over in popular surveys, a few of which were produced here and are not for kids).

Book Description
Polymorphism - the multiplicity of structures or forms - is a term that is used in many disciplines. In chemistry it refers to the existence of more than one crystal structure for a particular chemical substance. The properties of a substance are determined by its composition and by its structure. In the last two decades, there has been a sharp rise in the interest in polymorphic systems, as an intrinsically interesting phenomenon and as an increasingly important component in the development and marketing of a variety of materials based on organic molecules (e.g. pharmaceuticals, dyes and pigments, explosives, etc.). This book summarizes and brings up to date the current knowledge and understanding of polymorphism of molecular crystals, and concentrates it in one comprehensive source. The book will be an invaluable reference for students, researchers, and professionals in the field.
Book Description
The Disenchantments of Love, published in Spain in 1647 by Maria de Zayas, is a stunning collection of stories about women's amorous experiences in a patriarchal and imperialistic society during the turbulent seventeenth century. Now available for the first time in English translation, the ten exemplary novellas are set within an encompassing frame story that continues from the first collection, The Enchantments of Love: Amorous and Exemplary Novels, published in 1637. Both collections of love stories were immediately popular because of the novelty of their plots and the gender of their author.
What is new in the disenchantments is the deliberately feminist purpose stated in the rules for telling stories: only women are to narrate "true cases intended to disenchant women about men's deceptions," pointedly denying men the opportunity to dominate the storytelling. In the frame, however, the subtly ironic commentaries on the stories highlight the differences between masculine and feminine points of view. The conclusion of the frame reiterates the exemplary message that women are safe from men's physical and psychological abuse only in the sisterhood of the convent.
These ten sensational and bizarre tales focus on the ways lovers deceive women in order to "get their way," through magic, cross dressing as women, and rape--to the torture and murder of innocent women at the hands of their protectors--their fathers, brothers, and husbands. The graphic depictions of women's mutilated bodies are unprecedented in Western literature, as is the meticulous description of domestic violence that has traditionally remained private and hidden. A fascinating dimension of these fast-paced narratives is what they suggest through omission, silence, and ambiguous detail: the untold story that fires the reader's imagination.

Fabulous- Fabuloso.......1999-04-26
During the 17th Century, Spanish authors were mostly men. The women who wrote during the period usually were confined to the traditional writings of the era. Although Maria de Zayas y Sotomayor escapes from the norm of her time and really exposes the hardships women dealt with. Her stories will make you laugh, cry, and love. They are so beautiful. I have to thank my Spanish Literature professor for suggesting I read it.
This book is not only enlights one of Spain, but of women in general. I highly recommend this novel.
Amazing!.......1999-03-28
This book was one of the most amazing books I have ever read. The trials the women go through in this book because of the love they had for their men are nothing short of extraordinary. I would recommend this book to anyone who is ready to understand that women had to go through more than cleaning house. After reading this book you will never think about men or women during this time period the same.

¡Qué feminista! .......2006-12-19
Maria de Zayas is by far the most exciting female author to come out of Spain's Golden Age, if you consider the fact that this was in the 1600s. English nor French lit can touch this woman's commitment to educate women and have them realize that having a man isn't everything. Touching upon the mystical at times, her stories are grusome and desperate. I have never read such unique, descriptive stories in all of my life. I had the opportunity to read them in Spanish first, so if you are able to read them in their original language you should do so.
This book is a must for anyone interested in Spanish literature or even early feminism. You will be shocked, but interested to keep reading.
