Any writer or editor not concerned about copyright and libel ought to be. While the laws governing copyright are more straightforward than those regarding libel, disregarding either can land a writer or publication in a lot of hot water. Very hot. While the authors of The Copyright Permission and Libel Handbook state outright that their guide should not take the place of an attorney, they explain copyright and libel issues in great detail, so that, at the very least, you'll know when to be on the alert. Copyright is relatively simple. "If you intend to use someone's copyrighted work," say Jassin and Schechter, "unless the use is considered a fair use, you must obtain that person's written permission." Of course, "fair use" gets tricky. One court determined that the Moral Majority's reproduction of a full ad from Hustler magazine was a fair use, while another ruled that The Nation's reproduction of 300 words from President Ford's 20,000-word unpublished memoirs was not.

Libel is more complicated. Each state (and the District of Columbia) has its own libel laws. And, no, fiction is not exempt, even if you've changed the name and hair color of an otherwise identifiable person. "The best defense to libel," say the authors, "is verifiable truth." Included: detailed checklists--concerning fair use, copyright protection, copyright permission, libel, and "media perils" insurance--and sample forms for requesting permissions, obtaining releases, summarizing permissions, and writing libel disclaimers. --Jane Steinberg

5 out of 5 stars clear and to the point.......2000-10-18

While preparing to publish my second book (with number 3 on the way) I realized I needed some basic information about publishing and libel law. I found a copy of this book in the reference section of the law library at my university. The sections on libel were concise and to the point. I have not compared the book to other sources, but found it was very clear on the issues of importance to me. I've decided to order a copy to keep for reference, and I think it would be useful to most writers.

5 out of 5 stars Most Writers have two Copyright Questions.......2000-10-07

(From my book Successful Nonfiction: Tips and Techniques for Getting Published)

    1. How can I guard against others stealing my writing?

Relax. The moment you create a written Work, it is automatically copyrighted under Common Law. Once the book is published, you may send two copies to the Copyright Office with the two-page Form TX and $30 to register or perfect your copyright.

Some (new) authors copyright their manuscript. Later, when they turn it into a book, they print the original copyright date. This makes the book appear to be old, and that hurts sales.

Most authors wait and send the finished book to the Copyright Office for registration....

A registered copyright only gains the author some extra rights. The difference is between copyright and registered copyright, not between not copyrighted and copyrighted. Copyright occurs automatically with creation-when you initially write it.

Publishers rarely steal manuscripts. They are in the publishing business not the writing business. Manuscripts are cheap and publishers do not even have to pay the authors until months after the books are sold. There is little incentive to rip you off.

"The instinct of ownership is fundamental in man's nature." -William James (1842-1910), American philosopher and psychologist.

    2. How much may I borrow from others?

Borrow ideas, borrow facts, but do not steal words. Copyright covers the author's presentation or expression-a sequence or pattern of words. It does not protect ideas. If you read and blend the ideas of other authors and put the collective thought into your own words, that is perfectly legal. This is how most nonfiction books are written-from research.

Do not repeat any of the research materials word-for-word. Some of the material is not yours so copying could be plagiarism and you would be guilty of copyright infringement. Adapt the ideas from many sources so that your work is not substantially similar to any of them.

In Feist Publications, Inc. v. Rural Telephone Service Company, Inc., 111 S.Ct. 1282, 1287-88 (1991), the court held that the listings (facts) in a telephone directory were not protected by copyright.

Facts may not be copyrighted either; they are free for anyone to repeat or use in a manuscript.

"Copy from one, it's plagiarism; copy from two, it's research." -Wilson Mizner, screenwriter.

The Copyright Permission and Libel Handbook is divided into two parts: the first covers copyright and the second covers libel (written defamation). For coverage, click on Table of Contents in the left-hand column of this page. The appendix has sample copyright forms, disclaimers and resources.

    Book Description

The penalties for failing to learn the lessons of libel law are severe--a fact which is widely recognized by media professionals who are most at risk. Writers, print and broadcast journalists, film producers, and editors need a working knowledge of the law, in simple terms, with practical ways to avoid legal trouble. Attorney Neil Rosini meets that need with this practical handbook focusing on what the law is (and will likely be) and how media professionals can stay within its bounds. Rosini's unique three-step approach and lively presentation make a complex subject both entertaining and easy to understand. The book's first section, "What to Look For," shows the reader how to identify a libel. The rule here is straightforward: anything that damages reputation is potentially libelous notwithstanding the public or private status of the subject, or the quality or number of sources. The next section, "What Degree of Proof," discusses how much proof is necessary to support a potentially libelous statement. Through examples, the book demonstrates that a common-sense rule is usually the best: journalists must balance factors like the degree of potential damage to the subject, time pressures, the number and reliability of sources, the importance of the story, and the availability of corroboration, to determine whether proof is sufficient. In the third section, "What to Write," the book shows how to write a story to make the best use of available legal defenses. Simple precautions like changing the names and biographical details of subjects, or buttressing a story with references to legislative or judicial records, provide important legal advantages. The book begins by discussing the competing ideals of free speech and the protection of reputation and puts defamation suits in context. The book ends with "Quick Questions and Short Answers," plus a list of "17 Do's and Don'ts" for ready reference. Throughout the volume Rosini provides anecdotal examples which illustrate the rules and help them "sink in." The fact patterns, mostly taken from actual cases, involve a diverting group of private and public figures including a monkey scientist, the company behind the "97-pound weakling," Robin Williams, and Andy Rooney. Detailed footnotes and case citations also make this an indispensable resource for lawyers, academics, and students.

4 out of 5 stars A must for every journalist.......2001-05-30

"The Practical Guide to Libel Law" offers a three-step system for identifying potentially defamatory statements in news stories, gathering proof to back up the statements and writing your story to best take advantage of libel law. It's easy to follow and low on jargon. And Rosini's real-life examples were easy to apply in a deadline-obsessed newsroom. Especially helpful are the review questions, destined to be posted in cubicles everywhere. As a working journalist, I appreciate this refresher in the do's and dont's. I definitely will recommend it to coworkers.

        Book Description

In the light of increased public interest in the laws of libel, and the confusions and dramas recently involved, David Hooper's book aims to both inform and entertain. Can you sue for a bad reference, a bouncing check, or a parking ticket? Are you liable if other people repeat your libel? What do you have to prove to establish libel? There is libel in respect of a Christmas card, the corporation of McDonalds, the House of Nomura, Richard Branson, and Jeffrey Archer. In this book, even Hello magazine gets sued for libel—allegedly.

4 out of 5 stars Thoroughly entertaining and informative - a hoot to read.......2005-04-17

Subtitled Winners and Losers in the Libel Business and written by a British lawyer about English law , at first blush one would think this text would be about as exciting as watching the proverbial paint dry, or a wet weekend locked away on holiday with your wife and her mother, or worse still, your husband and HIS mother. But you'd be wrong. Dead wrong. A more entertaining, witty, revelatory and balanced overview of name calling is hard to imagine. Of course it is much more than this, but greed, power, envy, malice are some of the forces that drive the business and some of the David and Goliath tales that feature in this text make great reading not to mention the schadenfreude the reader fees at the fall of the vainglorious and powerful.
If you are interested in freedom of speech, understanding the power Rupert Murdoch wields through such tabloid organs as he possesses in New York and elsewhere, on the other hand the importance of the Fourth Estate in bringing to heel those who abuse power, or if you are interested in Vanity Fair, National Enquirer, Private Eye or True Confessions or celebrities, the right to privacy, the public good, the administration of the law, then you will find this a worthwhile, and entertaining, text. On my part, I am no lawyer, but am as interested in a good drama as much as the next man. And in libel law, there is plenty of that. Some comedy. Some farce. Perhaps even some tragedy.
Mr Hooper begins by relating the history of the law which is rooted in the 1275 statute Scandalum Magnatum and explains how the law works. My understanding is that it acted wholly in favour of the Lord of the manor who could take action against those who spoke ill of him. Thus it wholly favoured the powerful. He ends by discussing later reforms especially the Civil Procedure Act of 1997 in which the parties" should be on as equal footing as possible, that expense is where possible saved and that cases are dealt with in a way that is proportionate to the amount of money involved, the importance of the case, the complexity of the issues and the financial position of each party." p 450 In line with this direction towards simplicity, judges will increasingly take control of libel actions to ensure they are swiftly and less expensively brought to court, or are settled, or otherwise disposed of at an early stage. Under these new (Lord Woolf) proposals - including the adoption of Section of the New Zealand Libel Act 1992 - litigation is intended to be a last resort.
A welcome advance in the light of the commonly held layman's view (cf Richard Ackland on Defamation Law Sydney Morning Herald 15Apr05) that complex laws favour the income of the legal profession and it is in their interests to resist reform.
But problems exist between countries within the European Community as does between the states in the Comonwealth of Australia. For example, the French are much more forgiving of affairs by their Prime Minister,(the bedroom being a sacred place I gather) failing to see that these might compromise his ability to keep his mouth shut during a moment of delicious climax when he accidentally shouts out a state secret. C'est la vie! The author notes that, perhaps as a legacy of WW11, although Germany for example has freedom of speech enshrined in her Constitution, there is an unfortunate tendency for European countries to resort to criminal law in libel cases which he asserts should be strictly a matter of civil law.
In this excellent book there are some heady lessons - like the McDonalds case which lasted for 7 years and cost McDonalds $10,000,000 and their reputation even though they technically won on a number of points at issue. It was a case of advertising versus the truth and fought in a Corporate Orwellian world that Eric Blair envisaged was to be the province of Government or Bureaucracy. It was also a case of David ( in this case Englishman David Morris a single father and postman and Helen Steel a 26 year old ex-gardener) and Goliath (the McDonalds food corporation. It makes for fascinating reading. What a folly! What a waste of resources! But how frightening for the defendants having to suffer private detective investigations, seven years of courts and cross examination etc.
Moral of the book: try to get on with your neighbours.
It is worth every cent this book. Witty, inspiring, and very well written.

Textbooks tell us that the Earth is 4.6 billion years old and that the dinosaurs died out 65 million years ago. Just as our understanding of human history is helped by dates, so the history of the Earth and life of the geological past have also been dated by scientists. Most people have heard of radiocarbon dating, which can be used to date archaeological materials up to 50,000 years old, but how is it possible to put a date to a rock? It was only a couple of hundred years ago that many scientists still believed that the Earth was 6,000 years old, a figure calculated by Archbishop Ussher in 1650 from biblical chronology.

In The Dating Game: One Man's Search for the Age of the Earth, Cherry Lewis tells the fascinating story of how the rocks of the Earth came to be dated and of the role played by the English geologist Arthur Holmes in the intellectual and practical struggle to do so. You do not need to know any science to appreciate the remarkable and protracted effort by Holmes and his colleagues to discover how to measure time in rocks. They were using the same principles as those of radiocarbon dating; namely, the radioactive decay of certain elements that naturally occur in rocks. At one time Holmes became a shopkeeper to earn enough money before being able to return to his research. And then money for research in Britain was in such short supply that Holmes had to make a special plea to the university authorities for 74 pounds and 8 shillings for an electronic calculator to help speed up his work.

As a trained geologist, Lewis knows her subject. Although it is her first book, she tells the story well, making the technical details digestible by weaving them around Arthur Holmes's life story, so that they are accessible for the general reader. Diagrams, photographs, and a bibliography help make The Dating Game useful as well as enjoyable. --Douglas Palmer, Amazon.co.uk

                  Book Description

How old is the Earth? At the end of the nineteenth century, scientists were all looking for a clock that would provide an answer to this, the greatest Time question of all. The Dating Game tells the story of one man's vision of developing a geological timescale, a great vision which lasted fifty years despite scientific opposition, financial hardship and personal tragedy. Arthur Holmes fought to convince The Establishment of an Earth of great antiquity: a fight which eventually transformed the moribund 'art' of geology into a dynamic science.

3 out of 5 stars Interesting, but could have been even shorter!.......2001-10-28

The book is quite good, and I learned quite a lot (I don't know much anyway) about geology and planetology. But, the story of Mr. Holmes is not that interesting. Especially the 50 pages about his trip in Africa! Puh-leez! I love reading about the history of scientific discoveries, and I would have prefered more pages on the rejection of the continental drift theory.

                  4 out of 5 stars A good biography of a scientific giant.......2000-11-19

This is a fine read, well-written and researched. Holmes is a personal hero of mine and I was thrilled to see a biography about him. I learned a lot of things about him that I never knew, including where he got his fascination with E. Africa, his time with an oil company, and how he struggled to get an academic post (the vignette about his curio shop should provide inspiration to all young geologists struggling for their first academic job. Ms. Lewis does a good job of presenting Holmes, warts and all, including his somewhat unsavory dalliance with Doris Reynolds (nepotism is always with us). The author does a great job of capturing the excitement of young Holmes learning about the unfolding mysteries of radioactivity and his efforts to apply this revolution to understanding earth processes and history. There are lots of photos, I wish there were more. The only bone that I have to pick with the author is that Kelvin's true motivation for concluding the earth must be young is not presented early enough. Yes, evolution called for lots of time, but the sun screamed louder to the physicists that little time could have had elapsed. How could the sun have remained so brilliantly hot if it were as ancient as Darwin thought the earth must be? No one could imagine that the sun could produce its energy by nuclear fusion, a concept that wasn't dreamed of until well into the 20th century. Its heat must come from burning something and this combustion could not go on for long. Kelvin was right to conclude that because the sun must be young, so must the earth.

                  5 out of 5 stars A wondeful read.......2000-11-10

I read this book on my way from London to Edinburgh (and the return) trip. Although such a read might add to the cost of the book, I highly recommend doing the same thing since you can trace some of Holme's history as well! The book discusses the struggles of Arthur Holmes to establish geochronology as a legitimate science and to establish the age of the Earth. The scientific struggles are intertwined with a discussion of Holme's personal struggles and the reader truly gets a sense of scientific history throughout the book. It is interesting for other reasons as well. The book helps explain the source of many young earth creationist arguments against radiometric dating. These 'modern' creationists are merely recycling old arguments that Holmes and colleagues scientifically dismissed during the establishment of modern mass spectrometry. If you never understood the rigors and challenges of modern science this book will enlighten you as well. Cherry Lewis does a wonderful job explaining the rigors of peer-review and the difficulty in establishing a new paradigm.

                    Book Description

The use of explosives to generate ultrahigh pressures and thereby modify the structure and properties of condensed matter began in the 1950s and has since then become an important area of science. This book discusses the physical principles and experimental techniques of shock compression as applied to problems of inorganic chemistry and materials science. It begins with the fundamental physics of shock waves, the dynamic compressibility of solids, and physical and chemical transformations that may be produced by a shock. The second chapter turns to the experimental conditions for measurements and the preparation of ampoules. Subsequent chapters discuss: microstructural changes, such as fragmentation, shock hardening, and shock compaction; phase transformations in graphite, oxides, metals, and other materials; and chemical transformations, including mass transfer, decomposition, and diamond synthesis.

                      Book Description

One of the main goals of investigations of shock-wave phenomena in condensed matter is to develop methods for predicting effects of explosions, high-velocity collisions, and other kinds of intense dynamic loading of materials and structures. Based on the results of international research conducted over the past 30 years, this book is addressed not only to experts in shock-wave physics, but also to interested representatives from adjacent fields of activity and to students who seek an introduction to the current issues. With that goal in mind, the book opens with a brief account of the theoretical background and a short description of experimental techniques. The authors then progress to a systematic treatment of special topics, some of which have not been fully addressed in the literature to date.

                        Book Description

A substantial selection of classic essays allows readers to trace the history of the essay from Swift to Woolf and Orwell and beyond. A selection of the finest of contemporary essays—from Joan Didion to Witold Rybcynski—provides a broad sample of the genre in the late twentieth and early twenty-first centuries. The academic essays begin with classic selections from such writers as Darwin and Charles Lyell, but the emphasis is on recent decades. Emphasized as well are academic papers or essays that have been especially influential or controversial, from J. Tuzo Wilson's writing on continental drift to Judith Rich Harris's argument that the influence of peers may be at least as influential in the formation of personality as that of parents.

Works of different lengths, levels of difficulty and subject matter are all represented, as are narrative, descriptive and persuasive essays.

Also included in the text is a range of questions and suggestions for discussion. The text selections are numbered by paragraph for ready reference.

5 out of 5 stars excellent collection of essays.......2004-03-27

If you're looking for a great and eclectic collection of essays, look no further. I've looked at and taught from a lot of them, and this is my favorite. Broadview is a relatively small and sympathetic press that publishes great books in an attractive format--something about the paper, the feel of the book, appeals to me.

The selection is wonderful and gives you all the coverage you'd like, with great variety to race, gender, political perspective, and origin; the short questions after every selection work really well for journal entries, class discussion, or just private food for thought. What's perhaps more important, the book doesn't go overboard like a lot of textbooks that want to give you thousands of pages of stuff to have to choose from, or lengthy theoretical sections on how to read that everyone skips anyway. Broadview, in my mind, got it just right--and at a pretty good price too.
