This book offers an account of the performance of the welfare state in the European Union, and explores its future prospects in an ever evolving setting. The objectives of the welfare state are twofold: to relieve poverty and to provide a sense of security for everyone. It can be shown that over the last four decades the welfare state has been quite successful in achieving these objectives, more visibly in the Nordic countries than in the Southern or the Anglo-Saxon ones. But today the welfare state is at a crossroad. It is facing a variety of challenges that include demographic aging, the changing role of families, increased opportunism, economic integration and declining job security. All these challenges call for a drastic reform of the welfare state, one that requires more control of abuses and more accountability. The authors that it is crucial that all the components of the welfare state be made as efficient as possible, and that if a choice has to be made between alleviating poverty and protecting individuals against lifetime risks, priority should be given to the first objective. This book devotes a chapter to each of the main social protection programs: health care, unemployment insurance, pensions and child policies. In addition, special consideration is given throughout to the necessary interdependence among the State, the market and the family.

In recent years, gender has emerged as an important focus of attention in discourse in and around labour law. Gender is gradually moving from the margin to the mainstream of labour law debate, particularly with the development of a 'family-friendly' policy agenda. This book consists of a series of essays from an international selection of leading legal scholars exploring the shifting boundary between work and family from a labour law perspective. The object is to assess the global implications for labour law and policy of women's changing role in paid and unpaid work. The approaches adopted by the contributors' are diverse, both conceptually and geographically, encompassing analyses from Australia, North America, Canada, the UK, Europe and Japan, and including national and supra-national perspectives. Key themes informing the collection as a whole are the re-positioning of unpaid care work as integral to the performance and structure of productive activity; and consideration of the implications of recognizing the interdependence of work and family activities. In this way, the book seeks to develop a central theme from the previously published 'Labour Law in an Era of Globalization' (Conaghan, Fischl and Klare, eds. This book demonstrates how EC law has changed the traditional paradigm of Nordic labor law. The book argues that the integration of EC law into Nordic labor law provides a legal basis for requiring Nordic employers to observe a general standard of objectivity vis--vis their individual employees. This objectivity norm encompasses the EC law principles of non-discrimination, proportionality, effectiveness and legal certainty. Within Nordic labour law there has traditionally been a stronger emphasis on collective labor law and a weaker protection of individual employment rights than in other EU countries. It is the author's submission that EC law gives rise to a fundamental shift in the traditional paradigm of Nordic labor law as regards general framework, sources of law and general legal principles.
