Book Description
This book examines responsibility and luck as these issues arise in tort law, criminal law, and distributive justice. In revealing how the problems that arise in tort and criminal law as well as distributive justice invite structurally parallel solutions, the author also shows the deep connection between individual responsibility and social equality. This is a challenging and provocative book that will be of special interest to moral and political philosophers, legal theorists, and political scientists.
Customer Reviews:
Repetitive, Obscure, but Raises Interesting Issues.......2000-04-06
Read this for a seminar on Freedom and Responsibility. For those with a legal background, it presents little NEW material. The thesis is that the law's treatment of luck, risks, and responsibility (and everything else) stems from a concern about protecting the fair terms of interaction between persons. This focus tends to reject a legal subjectivist account of the law that centers on the subject's motives or beliefs in favor of looking at which actions a "reasonable person" would take to be fair in terms of the security and liberty risks of persons. While not quite offering a fresh perspective on legal analysis, the work does bring up many of the interesting issues and problem areas in the law.

Get to Work: A Manifesto for Women of the World

Book Description
In this bold new book, Linda McClain offers a liberal and feminist theory of the relationships between family life and politics--a topic dominated by conservative thinkers. McClain agrees that stable family lives are vital to forming persons into capable, responsible, self-governing citizens. But what are the public values at stake when we think about families, and what sorts of families should government recognize and promote?
Arguing that family life helps create the virtues and character required for citizenship, McClain shows that the connection between family self-government and democratic self-government does not require the deep-laid gender inequality that has historically accompanied it. Examining controversial issues in family law and policy--among them, the governmental promotion of heterosexual marriage and the denial of marriage to same-sex couples, the regulation of family life through welfare policy, and constitutional rights to reproductive freedom--McClain argues for a political theory of the family that embraces equality, defends rights as facilitating responsibility, and supports families in ways that respect men's and women's capacities for self-government.
Customer Reviews:
Illuminating and engrossing book.......2006-06-04
McClain's illuminating book offers a rich vision of family for the twenty-first century: one that is inclusive of many types of loving and critical family bonds, including same-sex relationships, traditional marriages, and grandparent guardians; one that makes us more responsible citizens; and one that earns the respect of government and in turn would give so much back to their communities. With so much political soundbites about family and marriage swirling about these days, this book joins the debate and offers a vision that shows how embarrassingly silly, and shortsighted, current debate is about marriage, sex education, and family. The book is philosophical and at the same time beautifully written and accessible. It really touched me and showed me how critically important our vision of family is to our democracy and society in this increasingly disconnected information age. I loved this book -- as a working mother, as a teacher, and as someone who wants to contribute more to those around me. Now, if I only could ensure that our country's leaders read it, we would be in much better shape!
A much needed book.......2006-01-18
Well-written, though-provoking survey of the social, legal and political terrain of "family" policy, and the competing theories and practices thereto. Hopefully this will lead to a more intellectually honest discussion of "the place of families" in American law.

Book Description
Arguments about distributive justice often take place around two ideas. One is that good should be distributed equally. The other is that how people fare in life should depend on what they are responsible for. The author asks what draws us to these two ideas and examines recent attempts by egalitarian thinkers to bring them together in a single distributive ideal. Underlying this ideal is the egalitarian intuition - the intuition that it is objectionable for some to be worse off than others through no fault of their own. in a wide-ranging discussion, Lake tests that intuition from a variety of perspectives and points to the gaps in our current thinking about quality and individual responsibility.

Book Description
Collins, Charles Wallace. The Fourteenth Amendment and the States: A Study of the Operation of the Restraint Clauses of Section One of the Fourteenth Amendment to the Constitution of the United States. Boston: Little, Brown, and Company, 1912. xxi, 220 pp. includes tables and diagrams. Reprinted 2004 by The Lawbook Exchange, Ltd. ISBN 1-58477- 463-0. Cloth.
* Collins examines the origins of the amendment and the way its scope was enlarged over time. He argues that it has failed to protect African-Americans, and that its application in extra-racial matters has led to excessive litigation and harmful restrictions on the states. "This book is interesting throughout; but perhaps the most striking parts are those in which the author gives the figures as to the number of cases, their nature, and their geographical distribution.": Harvard Law Review 26:664-665 cited in Marke, A Catalogue of the Law Collection at New York University (1953) 408.

Heaven's Door: Immigration Policy and the American Economy
ASIN: 1572304030 |
Book Description
Once the prime destination for westward-moving young Americans, California has become a magnet for a new wave of migration in recent years. Changes in immigration law and the ebbs and flows of the increasingly global economy have led to an unprecedented influx of newcomers from every continent and every cultural, ethnic, and socioeconomic group. How has the demographic structure of California changed in the past 15 years? What are the social and spatial consequences of this transformation? Where are the new immigrants living, and how successfully are they realizing their versions of the American dream? Examining the impact of large-scale immigration on local communities, this book presents an in-depth geographical case study of the most active "melting pot" in the United States today.
Customer Reviews:
Important Observations.......2001-11-13
Clark's main thesis is that if the current immigration patterns persist in California that state and the nation as a whole could be in serious trouble. The population of Califrnia due to immigration is exploding (mostly with hispanics who are not assimilating well). These immigrants tend to gather together causing strains on local communities in providing public services to these immigrants.
Clark believes entry into the United States should be based more upon skills and human capital rather than family reunification. Furthermore, he believes increased funding in education should put forth on the part of the federal government. Hopefully, in his opinion, this will even the playing field somewhat and help immigrants assimilate more effectively.
This book is a worthwhile read especially for those interested in immigration and its potential effects on local communities.

Customer Reviews:
An excellent summary of issues facing modern societies.......1998-07-23
This book presents, in clear and easy to understand language, a nearly complete summary of the problems and issues of technology that face a modern society. Issues ranging from alternative energy sources and traffic theory to the problems of feeding the world's growing population are addressed. This book allows one to approach such modern questions as "Should I have airbags in my car?" or "How dangerous is the nuclear power plant in the next town?" from a knowledgeable standpoint. Many worked examples are included. Reference lists and problems are included at the end of each chapter. Although written as a textbook, this is an excellent (and entertaining) resource for the general interested reader. (Disclaimer: I am a former student of one of authors, but never took the class for which this book was written.)

Customer Reviews:
One of the best American books of short stories.......2006-07-29
I've read many books of short stories in my life, by authors such as Gabriel Garcia Marquez, Ernest Hemingway, Jorge Luis Borges, Saul Bellow, Haruki Murakami, Julio Cortazar, Ian McEwan etc. (all great writers in their own right), but none of these authors has been able to write stories as exciting, complete, and satisfying as Fitzgerald's in "Six Tales of the Jazz Age and other stories." In this book, Fitzgerald combines wit, Jazz Age glamour, emotions and moral messages to perfect effect. "The Jelly-Bean" is a tale of love and longing between a Southerner and a wild woman. "The Adjuster" tells of a wife who learns to be less selfish in her demands of her husband, and in "'O, Russet Witch!'" a woman symbolizes a man's desire to be irresponsible and spontaneous as he tries to live up to the responsibility that society and his family demand of him. "Gretchen's Forty Winks" is about the balance between work and responsibility to one's partner. "The Curious Case of Benjamin Button" narrates the (somewhat) absurd story of a man born old who lives his life getting steadily younger (I was reminded of Alejo Carpentier's "Viaje a la semilla" (Journey to the Seed), but Fitzgerald's story is better and slightly more daring). "The Camel's Back" is a lighter tale of confused identities, while "Hot and Cold Blood" ponders the conflicting responibilities to family and society.
Any writer could match Fitzgerald's moral demands, but few would be able to make such stories as entertaining and fast-paced as he does. I used to hate Fitzgerald as a writer--due in large part to being too young to appreciate what "The Great Gatsby" was really about (I read it in high school)--but these stories have inspired me to try to read (and in the case of the "Gatsby," re-read) the rest of his works. I highly recommend this book to all those who love great, profound, and thoroughly entertaining literature.
