Introduction.
"This eloquent and moving memoir raises profound questions about law, justice, tradition, and community; the path to constructive social change; and not least, how to live a decent life. It is an inspiring story, with many valuable lessons to ponder."Noam Chomsky
"
Success Without Victory is thoughtful and provocative, and I highly recommend it. It is highly readable, includes fascinating stories centered on powerful personalities and the sustained reflection on unilateral presidential war-making powers is timely."
Law and Politics Book Review
"A vivid illustration. The book makes a valuable contribution to our evolving understanding of the work of cause lawyering and the significance of test case litigation. It stands as a beacon of hope in an era dominated by pessimism about the capacity of law and lawyers to contribute to progressive social change."
American Historical Review
"An intriguing cultural analysis."
Bookwatch
"For the author in this compelling book, success and failure are not determined by the immediate outcome of a given case; a lawsuit can be deemed successful if it arises from and gives expression to a valid principle and if it promotes culture of rights."
Publishers Weekly
"Excellent. His work is prophetic and should inspire a new generation to choose law as an alternative to war."
Federal Lawyer
"Remarkable. Jules Lobel takes his rightful place alongside the line of lawyers opting for the difficult path of bringing contentious issues into the public forum."
New York Law Journal
"Lobel provides a lively account of several important but relatively unknown cases. The stories are fascinating and will engage litigators who love the details of brief-writing, the tension of last-minute deadlines, the strategies for oral argument, and the drama of judicial decision-making."
Trial
Winners and losers. Success and failure. Victory and defeat. American culture places an extremely high premium on success, and firmly equates it with winning. In politics, sports, business, and the courtroom, we have a passion to win and are terrified of losing.
Instead of viewing success and failure through such a rigid lens, Jules Lobel suggests that we move past the winner-take-all model and learn valuable lessons from legal and political activists who have advocated causes destined to lose in court but have had important, progressive long term effects on American society. He leads us through dramatic battles in American legal history, describing attempts by abolitionist lawyers to free fugitive slaves through the courts, Susan B. Anthony's trial for voting illegally, the post-Civil War challenges to segregation that resulted in the courts' affirmation of the separate but equal doctrine in Plessy v. Ferguson, and Lobel's own challenges to United States foreign policy during the 1980s and 1990s.
Success Without Victory explores the political, social, and psychological contexts behind the cases themselves, as well as the eras from which they originated and the eras they subsequently influenced.

Part of the New York University Press "Critical America" series, Jules Lobel's Success Without Victory: Lost Legal Battles And The Long Road To Justice In America documents lost legal battles and the road to justice in America. Lobel views the drive to win in American culture, analyses the price of success, and suggests lessons be learned from legal and political activists who have advocated losing causes in court, only to make long-term impressions and differences in American society as a result. Selected court cases outline his contentions.

Book Description
The Last Days of Big Grassy Fork recounts newspaperman Hunter James's attempts to save his 100-year-old family farm and homestead from extinction. Wise, irreverent, pugnacious, and often hilarious, James fights back against the galloping urbanization of his beloved North Carolina piedmont.
Interweaving current affairs and family history, James details the growth of the Winston-Salem area as a center of Moravian piety and later as the world's largest tobacco manufacturing center. This personal history shows he is not the only James to have had a difficult time fitting in with the neighbors' idea of progress; his family's trouble in the Piedmont began early. In 1904 his grandfather was flooded out of a brothel in his birthday suit, and he later scandalized the local Baptist church with drunken sermons, exposing the dark secrets of the congregation.
James's unique sense of the absurd, and his willingness to play the fool, make for entertaining reading as each of his efforts at preservation fail miserably. He accidentally torches a neighbor's barn in an attempt to burn off his best pasture land, as was always done in the past; he squanders enormous amounts of money vainly trying to save his farm by becoming the piedmont's preeminent lord of the manor, vintner, wine snob, and horseman; and he finally seals his own doom when in alliance with his neighbors he inadvertently creates the world's largest garbage pit.
The book ends with an eloquent plea for a true Agrarianism in the modern South, for the need to strike a balance between the call for industrial expansion and the desire to preserve the land.

Fighting Urban Sprawl.......2002-05-11
This work should be of more than passing interest to those who more and more find themselves beset on every side by urban sprawl. The author sets out in many ways to preserve an old family homestead; but, more important, seeks ways to make the place profitable. His attempts are often hilarious, the more so when they fail, and they never lack meaning for others who share his feelings about the need for ways to protect ourselves from the menace of an urbanization that has rapidly got out of contol.

Book Description
It has been recognized that viruses can induce neuronal damage by a variety of mechanisms. This volume summarizes, for the first time, the various ways that neurons can degenerate under the influence of viral infection, ranging from acute necrosis and virus-induced apoptosis to chronic damage in persistent infections. The mechanisms of neuronal latency are dealt with as well. The volume also includes chapters that review the chronic damage caused by viral proteins that interfere with differentiated functions of the neuron, including signaling by neurotransmitters and signal transduction by trophic factors. Other chapters deal with the controversial role of cellular immune reactions, which may be helpful in controlling infection, but may also be detrimental to the host nervous system. The specific mechanisms of damage involved in retroviral infections and in prion diseases of the nervous system are reviewed, and finally how autoimmune diseases can lead to neuronal damage.

Book Description
Today, earth and life scientists are increasingly confronted with the puzzling complexity of phenomena enmeshed in a seemingly boundless web of interrelations. To deal with this complexity and to further our ability to analyze and predict system behavior, science is learning to transcend reliance on averages and ‘permanence’ and to consider the fundamental multiple-scale character of phenomena. The contributions collected here detail techniques of multi-scale and fractal analysis that enhance the study of geo-complexity. They represent a multi-disciplinary approach to understanding the geological history of a section of the Lower Rhine River. They have in common the underlying question of how our qualitative modelling of natural phenomena do or do not prove the existence of representative averages.

Book Description
Inequalities play an important role in almost all branches of mathematics as well as in other areas of science and engineering. This book surveys the present state of the theory of weighted integral inequalities of Hardy type, including modifications concerning Hardy-Steklov operators, and some basic results about Hardy type inequalities and their limit (Carleman-Knopp type) inequalities. It also describes some rather new fields such as higher order and fractional order Hardy type inequalities and integral inequalities on the cone of monotone functions together with some applications and open problems. The book can serve as a reference and a source of inspiration for researchers working in these and related areas, but could also be used for advanced graduate courses.
Book Description
A hysterical new novel from the author of What's Wrong with Dorfman?Once a gangly teenager in oversized clothes, Plato G. Fussell is now handsome and independently wealthy. But inside he's still a bundle of neuroses and anxieties, with a tendency to engage in moronic word games in the presence of beautiful women.In the midst of working on his definitive ten-volume biography of Millard Fillmore, Plato finds himself dodging his vile ex-wife, trying to please his demanding elderly mother by inquiring weekly about the state of her bowels, and attempting to remain verbally coherent while courting a young woman whom he meets after her errant Frisbee connects with his cranium.As Plato blunders on in search of true love, romance, and an acceptable degree of worldwide cleanliness, he discovers that loving someone and knowing them needn't go hand-in-hand.

A Breat Gook!!!.......2007-02-10
That's right.....a great book!!. Fun, fun....Always another surprise just jumping right up. You'll learn all about agoraphobia....I "googled" the definition and clipped it to the cover. The main character, Plato G. Fussell is unbelievable ....The first few pages may make you wonder if you need to pursue it but....just wait. You're in for a hilarious trip. Not to be missed!!!
Hilarious and quirky.......2005-04-04
This isn't your casual love story. This is a story about a slightly eccentric Plato G. Fussell, rich, handsome, and a bit obsessive-compulsive. I loved the storyline as it was rich in great detail and Blumenthal's use of puns kept me smiling throughout the entire novel. Moreover, Plato becomes such a lovable character that you don't realize how crazy he really is! I enjoyed this book because it is lighthearted, and carries a somewhat whimsical tone. It is a story that will warm your heart as it has warmed mine.
Most Interesting Psychological Romance!.......2004-12-23
After being damaged to the core by his high school sweetheart, Plato Fussell has given up on love. Between being rich and obsessive compulsive, Plato knows that finding someone that honestly loves him will be nearly impossible.
When love finds Mr. Fussell again, it is with another obsessive compulsive patient... whom he finds out just happens to be his psychiatrist soon to be ex-wife.
Once you add the health problems of his father, his mother's wild antics - this book will keep you giggling for hours.
As a nurse and romance author who worked with psychiatric patients for almost two years, it was not hard at all to picture this family and all their little quirks.
I really connected with this book also in the fact the I graduated from High School the same year as Plato Fussell. I could imagine very vividly his High School years and what was going on at the time in the world.
Mr. Blumenthal does an excellent job in portraying these serious psychological problems into a book full of hilarious antics. One of the most interesting psychological romances that I have ever read!
Wonderfully Entertaining.......2004-12-01
If Woody Allen were still making funny movies, they would be a lot like John Blumenthal's books: full of hilarity, wisdom and the quirkiest characters this side of a Tom Robbins novel.
In his latest, we meet Plato G. Fussell, a garden variety neurotic who happens to be writing the definitive 10 volume biography of America's most forgotten President, Millard Fillmore. Plato, who believes that romantic love is nothing but hogwash, has a slight problem meeting women: he tends to speak gibberish in their presence, an uncontrollable tick of some sort. He spouts spoonerisms and says names backwards. But when he happens to meet the delectable Emily Thorndyke, a woman afflicted with a whole other set of equally interesting neuroses, he can't help but fall in love with her, in spite of his dismissal of romantic love as "a monstrous flimflam perpetrated on the gullible masses by a cabal of soulless profiteers."
The book has more than a few unexpected twists and turns and kept me guessing the whole time. And the ending is a marvelously crafted surprise. But Blumenthal is more than just a simple comedy writer - his novels tell us something profound about the human condition and "Millard Fillmore, Mon Amour" is no exception.
Couldn't Put it Down.......2004-11-02
It's not easy to make me laugh aloud when I'm all by myself reading, but John Blumenthal did with his latest hilarious book, "Millard Fillmore, Mon Amour."
Between the hypochondriacal antics of Plato G. Fussell to those of his even-weirder mother, this book will keep your floor clean because you'll be rolling all over it.
My friends can always use a laugh, so I bought a bunch of copies for holiday gifts.

Book Description
The US Army and Marine Corps in World War II considered themselves highly mobile, offensive forces. Their mobile-warfare doctrine envisioned field fortifications and obstacles as temporary in nature. As a result, their design was simple and made use of local materials, and they could be constructed comparatively quickly, whilst still providing adequate protection. By the time of the Korean War, only minor changes had been made to field fortification construction and layout, and to small-unit organization, weapons, and tactics. This title addresses field fortifications built by US infantrymen during World War II and in Korea, and covers rifle-platoon positions, trenches, crew-served weapon positions, bunkers, dugouts, shelters, observation posts and anti-tank obstacles.
Customer Reviews:
Both doctrine and practice covered--with the "official" omissions included.......2006-02-08
This Osprey Fortress-series book covers both doctrine and practice. It is often said that the infantryman uses his E-tool more often than his rifle. Illustrator Ian Palmer depicted company and battalion defensive positions, as well as details on individual positions for riflemen and heavy weapons. Some of these illustrations are the same ones used in US Army field manuals (both War Department and the modern Department of Defense). Tables and sidebars give such important information as unit frontages, amount of materials required for protection, equipment allocated for infantry units constructing field fortifications, and weapon ranges. One item often left out of the official field manuals is the weapons' transverse and elevation limits-so I cannot fault Gordon L. Rottman for not including these tables in US World War II and Korean War Field Fortifications 1941-53. During my 24 years in uniform, I ran into company and battalion leaders with infantry experience who still didn't know that the T&E for the M60 was only plus or minus 400 mils (covering 800 meters at 1000 meters distance); this was important because they treated weapon positions as if each one had 360-degree fields of fire with full elevation to cover every inch of ground. Rottman's text and Palmer's images show the battlefield obstacles used to deny enemy access to these weapon dead-spaces (places where weapon fires couldn't reach)-though land mines (classified as "obstacles" by American doctrine) are not detailed in this thin volume. That is a flaw shared by the official DoD US Army Field Manuals covering field fortifications-land mines and demolitions are covered in another FM. Besides, there might be some official displeasure at providing "terrorist bomb manuals" to the general public by publishing literature on mine warfare.
I cannot fault the paucity of communications coverage in US World War II and Korean War Field Fortifications 1941-53, even though that is an important part of the defense and even though both WWII and Korean War accounts by the low-ranking soldiers are replete with laying and repairing field telephone wires-the official manuals don't cover communications very well because there are separate field manual and technical manual (FM and TM) libraries on the subject. On the other hand, communications knits together the defense. Infantry combat is a team sport requiring coordinated effort-not an individual competition. Field telephones, radios, pyrotechnics, whistles, bugles, sirens, arm and hand signals, and the Mark One Leather Lung are as important as sand bags and the entrenching tool for the defense. Without communications, the command post was a waste of time-the command post served as a communications center for the platoon, company, battalion, or regiment on the line.
Listening posts (LP) and observation posts (OP) are mentioned and their placement and construction explained. LP's and OP's exist to provide as much advance warning as possible. They are the entrenched commander's primary combat information tool, with his own local combat and recon patrols being secondary (never enough people to do everything-and in Korea, sometimes patrols were prohibited to "encourage" the Chinese to come to the peace table...) LP's and OP's, along with troops in the trenches and "foxholes" along the front line, were supposed to have communications with the command post-otherwise, putting your boys in harms way was futile.
Lots of people who should know better criticize the "World War One trench warfare" tactics-while praising the enemy forces' use of field fortifications or even permanent fortifications as progressive. Rottman's book covers the evolution of American (the Marines used the same doctrine) field fortification theory and practice during World War Two and the Korean War. I like this book and even though modern US Army field fortification doctrine has changed, the drawings and illustrations and text would permit me to instruct leaders and junior soldiers in the practice of field fortification. Communications trenches are vital even today in Iraq and Afghanistan because of random mortar and rocket attacks. Yes, fortifications protect against the Vehicle Borne Improvised Explosive Device (VBIED: aka "car bomb" or "truck bomb") and suicide bomber wearing an explosive vest the same way that they protected my WWII and Korean War predecessors from tank attack, artillery shells, and infantry weaponry. Actually, in World War Two there were Japanese suicide bombers. Korean War vets tell me of Communist suicide bombers as well. Though these suicide attackers didn't get mentioned in Rottman's useful index, the illustrations show how interlocking fields of fire was intended to provide a leak-proof defense. Combat is dangerous and attrition is expected-interlocking fields of fire not only catches attackers in a cross-fire, but in the event that one or more crew served weapon or individual rifleman fighting positions are destroyed, overlapping fields of fire provide uninterrupted coverage. Sometimes.
The neat photographs and illustrations may give a false impression of defensive fortifications as static and passive. Effective defense positions are elastic-Rottman's text mentions secondary and alternate defensive positions. The ability of the rifle platoons to launch counter attacks or even conduct offensive operations using their "trench line" as a fire support base was considered in the design and construction of fortified positions. Usually.
I recommend US World War II and Korean War Field Fortifications 1941-53 become part of the library for the amateur WWII historian, for the modeler as a guide to dioramas, and for the war gamer. It does have application for the modern soldier, too, in the absence of current training materials.

Informative and thorough.......2004-09-15
This book presents a state-of-the-art comparative study of women's roles in the Middle East as of 1990. The author draws together a large number of statistics and research as she discusses how and why women's status varies across the region. The book can be succinctly summed up in the following quote: "Many studies on the Middle East and commentaries by Islamists themselves tend to understate the heterogeneity of the region; they project a uniform culture and exaggerate its importance, elevating culture or religion to the status of single explanatory variable. My alternative position is that there is an interactive relationship of economic processes, political dynamics, and cultural practices." In addition to describing the general situation throughout the region, the author presents two case studies: Iran and Afghanistan. The information in the case studies is highly illuminating and I have not seen such detailed discussion on these topics elsewhere. In places, the author goes a little off topic, such as when she describes the French Revolution or the Russian Revolution; although the information presented in these sections is somewhat interesting, it's not clear why it was necessary or appropriate to include them. The author also has the annoying habit of relying extensively on acronyms whose meanings can be hard to keep track of. Overall, though, the book is a valuable reference for those interested in women in the Middle East.
Book Description
From the cleric-led Iranian revolution to the rise of the Taliban in Afghanistan, many people have been surprised by what they see as the modern reemergence of an antimodern phenomenon. This book helps account for the increasingly visible public role of traditionally educated Muslim religious scholars (the `ulama) across contemporary Muslim societies. Muhammad Qasim Zaman describes the transformations the centuries-old culture and tradition of the `ulama have undergone in the modern era--transformations that underlie the new religious and political activism of these scholars. In doing so, it provides a new foundation for the comparative study of Islam, politics, and religious change in the contemporary world.
While focusing primarily on Pakistan, Zaman takes a broad approach that considers the Taliban and the `ulama of Iran, Egypt, Saudi Arabia, India, and the southern Philippines. He shows how their religious and political discourses have evolved in often unexpected but mutually reinforcing ways to redefine and enlarge the roles the `ulama play in society. Their discourses are informed by a longstanding religious tradition, of which they see themselves as the custodians. But these discourses are equally shaped by--and contribute in significant ways to--contemporary debates in the Muslim public sphere.
This book offers the first sustained comparative perspective on the `ulama and their increasingly crucial religious and political activism. It shows how issues of religious authority are debated in contemporary Islam, how Islamic law and tradition are continuously negotiated in a rapidly changing world, and how the `ulama both react to and shape larger Islamic social trends. Introducing previously unexamined facets of religious and political thought in modern Islam, it clarifies the complex processes of religious change unfolding in the contemporary Muslim world and goes a long way toward explaining their vast social and political ramifications.

Book Description
Is this book about patterns?
Yes and no. It is about software reuse and representation of knowledge that can be reapplied in similar situations; however, it does not follow the classic Alexandine conventions of the patterns community--i.e. Problem- solution- forces- context- example, etc. Chapter 6 on claims comes close to classic patterns, and the whole book can be viewed as a patterns language of abstract models for software engineering and HCI.
So what sort of patterns does it contain?
Specifications, conceptual models, design advice, but sorry not code. Plenty of other C++ code pattern books (see PLOP series). Nearest relative in published patterns books are Fowler's (1995) Analysis Patterns: Reusable object models and Coad, North and Mayfield.
What do you mean by a Domain Theory?
Not domains in the abstract mathematical sense, but domains in the knowledge--natural language sense, close to the everyday meaning when we talk about the application domain of a computer system, such as car rental, satellite tracking, whatever. The book is an attempt to answer the question ' what are the abstractions behind car rental, satellite tracking' so good design solutions for those problems can be reused.
I work in industry, so what's in it for me?
A new way of looking at software reuse, ideas for organizing a software and knowledge reuse program, new processes for reusing knowledge in requirements analysis, conceptual modeling and software specification.
I am an academic, should I be interested?
Yes if your research involves software engineering, reuse, requirements engineering, human computer interaction, knowledge engineering, ontologies and knowledge management. For teaching it may be useful for Master courses on reuse, requirements and knowledge engineering. More generally if you are interested in exploring what the concept of abstraction is when you extend it beyond programming languages, formal specification, abstract data types, etc towards requirements and domain knowledge.
ADDITIONAL COPY:
Based on more than 10 years of research by the author, this book is about putting software reuse on a firmer footing. Utilizing a multidisciplinary perspective--psychology and management science, as well as software--it describes the Domain Theory as a solution. The domain theory provides an abstract theory that defines a generic, reusable model of domain knowledge.
Providing a comprehensive library of reusable models, practice methods for reuse, and theoretical insight, this book:
*introduces the subject area of reuse and software engineering and explains a framework for comparing different reuse approaches;
*develops a metric-oriented framework to assess the reuse claims of three competing approaches: patterns, ERPs, and the Domain Theory OSMs (object system models);
*explains the psychological background for reuse and describes generic tasks and meta-domains;
*introduces claims that provide a representation of design knowledge attached to Domain Theory models, as well as being a schema for representing reusable knowledge in nearly any form;
*reports research that resulted from the convergence of the two theories;
*describes the methods, techniques, and guidelines of design for reuse--the process of abstraction; and
*elaborates the framework to investigate the future of reuse by different paradigms, generation of applications from requirements languages, and component-based software engineering via reuse libraries.
