John Marshall remains one of the towering figures in the landscape of American law. From the Revolution to the age of Jackson, he played a critical role in defining the "province of the judiciary" and the constitutional limits of legislative action. In this masterly study, Charles Hobson clarifies the coherence and thrust of Marshall's jurisprudence while keeping in sight the man as well as the jurist.
Hobson argues that contrary to his critics, Marshall was no ideologue intent upon appropriating the lawmaking powers of Congress. Rather, he was deeply committed to a principled jurisprudence that was based on a steadfast devotion to a "science of law" richly steeped in the common law tradition. As Hobson shows, such jurisprudence governed every aspect of Marshall's legal philosophy and court opinions, including his understanding of judicial review.
The chief justice, Hobson contends, did not invent judicial review (as many have claimed) but consolidated its practice by adapting common law methods to the needs of a new nation. In practice, his use of judicial review was restrained, employed almost exclusively against acts of the state legislatures. Ultimately, he wielded judicial review to prevent the states from undermining the power of a national government still struggling to establish sovereignty at home and respect abroad.
No chief justice and only one associate justice (William Douglas) served longer on the Supreme Court. But, as Hobson clearly shows, Marshall's deserved place in the pantheon of great American jurists rests far more upon principles than longevity. This book better than any other tells us why that's true and worthy of our attention.

This is how he did it................2007-08-20
John Marshall [1755-1835] was Chief Justice of the United States for the last 34 years of his life. During his long tenure, he turned the Supreme Court from an afterthought into a primary tool for the centralization of federal power; he defined America, though we can still debate whether he got the definition right. This book details how Marshall went about his task.....
This is NOT a biography of John Marshall [see my other reviews]; it is a series of case studies which trace the expanding power of the Federal Judiciary...Marbury v. Madison established the principle of Judicial review of legislative decisions...Virginia v. Cohens asserted federal authority in state affairs...the National Bank...land titles...Indian treaties......there is still disagreement over some of Marshall's decisions, and there was hell to pay over some of them at the time. "John Marshall has made his decision; now let's see him enforce it"...the various ramifications of that statement {which Andrew Jackson MAY not have ever made} are mind boggling....
Charles Hobson is editor of The John Marshall Papers, one of the 2 or 3 greatest living Marshall scholars, and a nice guy [as was Marshall]; he has written a five star book. Do I actually recommend it? Maybe. If you are an attorney or historian with an interest in the topic, it is an absolutely essential volume. Well written, well organized; for me, it was a page turner. For the casual reader, don't waste your money, or insult Mr. Hobson. You will need a good background in either Law [not me], or history [me] to understand it.

Compelling and Disturbing - Great Read about CIA and Guatemala.......2006-10-25
This book was recommended to me in 1997 while traveling to Guatemala for the first time. The book is very captivating and interesting, providing not just a love story between the author and Everado, her husband, but inside info about the 36 year civil war in Guatemala that "ended" with a Peace Treaty in 1996. This book is very sad, disturbing, and yet, empowering. Jennifer Harbury stands firm in the face of adversity and intense opposition from the US (CIA) and Guatemalan governments. She pursued justice at all cost, for the sake of the poor in Guatemala and her beloved Everado. Tragic story, yet very enlightening.
A Very Human Story.......2002-12-23
Harbury's book tells a griping and human story about a woman's search for the truth. A "Reader" who left a negative review is mistaken in his/her accusation that Harbury and Bamaca were never married, sadly this is one of the lies that the Guatemalan Government has spread in a attempt to discredit Harbury. As to attrocities committed by the Guerillas, its true 3% of all human rights abuses were committed by the Guerillas (this figure is from the UN truth commission the Committee for Historical Clarification). And while there is no excuse for these violations of human rights it must be put into the perspective and compared to the 93% of human rights violations committed by the Guatemalan Army. Harbury's story puts a human face to this effects of a very violent and tragic civil war. However if you want to know more I would recommend " Guatemala: Never Again" by
the archdioses of Guatemala.
If only people knew the WHOLE truth.......2002-09-10
Unfortunately, what a lot of people don't know is that Harbury has done more damage to Guatemala's economy and native people (who she claims to want to help), more than any good. As a result of her demands for "justice," and attempting to cause a stir here in the US and the rest of the world, much aid and tourism has gone down through the years, hurting the country's economy and businesses/vendors of those who rely on tourism. Those who make a living selling goods and bringing home bread and sustenance for their families are the ones who have suffered the most by Harbury and her scandalous accusations - NOT the military. Does she mention all the atrocities the guerrillas committed (and continue to commit), as well as the army? I seriously doubt it. When I was there, many murders, rapes, and other atrocities were regularly committed by these so-called "fighters of freedom" - the guerrillas. I personally knew some of the poorer natives who were continuously intimidated and threatened by them. Bamaca was no exception.
What about the average Guatemalan citizen? What do they think of Harbury? You'd be surprised - most Guatemalans do NOT want her there, and have always considered her a nuisance to their country, for the exact reasons I mentioned above. I'll give you a first-hand account: During the years I lived there, one of the times I was in downtown Guatemala City (Central Square), Ms. Harbury was holding a "hunger" strike in the middle of city square, across the street from the Presidential Palace, camping in a small tent. The only people who seemed somewhat interested were a few traveling young tourists, standing around her tent taking pictures. The average citizens were paying no attention to her, walking by going about their business....as I said, they consider her a nuisance to their country. The only folks there who speak up for her are those who have political agendas, or those who aren't from Guatemala.
*One note I'd like to point out - Harbury and Bamaca were never actually married - in the early 90s she obtained a marriage license and got "legally wed" at a Texas courthouse, without him ever being present -- because he'd already been dead for years! Being a lawyer, she somehow pulled this off and made it "legal." One of the reviewers of this book falsely claimed that this is a lie spread by the Guatemalan government. On the contrary, I got the account in an article from the Dallas Morning News(!), circa 1994, when she obtained the "marriage license" that year in a small Texas town. Investigate for yourself if there's any doubt. If only the American public knew the "whole story" of Jennifer Harbury. Best thing to do - go get an opinion from the average Guatemalan citizen - they'll give you the facts. Good news is these days she's becoming a forgotten figure....for the good of the Guatemalan people and nation. Tragically we may never know the extent of the harm that she's done to that wonderful country.
Truth.......2001-07-08
Harbury's book is magnificent. It allows readers to glimpse the truth, the agony, behind civil war in Central and South America; and it explores every inch of the tear-stained emotions of the author. It has eyes that see the entire circle of human affairs, exploding into a grisly flow of blood that allows for no escape. The author paints a world of pain and joy, and of irrevocable loss; I cried at its conclusion. The book lodged itself into my soul and has not ever left.

Searching for Everardo is one of the most touching books I've read in awhile. This book truly opened my eyes to a world I've never really seen. Harbury's writing is eloquent, natural, and most of all honest. Not only do you learn about a history that isn't told in school books, but you also learn about human nature -- both good and bad. I would highly recommend Searching for Everardo to anyone who wants his/her eyes opened a little bit. This book might not change the world or its politics, but it will change the reader, and we can only cause change to happen one step at a time.

Poet Kim Barnes grew up in northern Idaho, in the isolated camps where her father worked as a logger and her mother made a modest but comfortable home for her husband and two children. Their lives were short on material wealth, but long on the riches of family and friendship, and the great sheltering power of the wilderness. But in the mid-1960's, as automation and a declining economy drove more and more loggers out of the wilderness and into despair, Kim's father dug in and determined to stay. It was then the family turned fervently toward Pentecostalism. It was then things changed.
In the Wilderness is the poet's own account of a journey toward adulthood against an interior landscape every bit as awesome, as beautiful, and as fraught with hidden peril as the great forest itself. It is a story of how both faith and geography can shape the heart and soul, and of the uncharted territory we all must enter to face our demons. Above all, it is the clear-eyed and moving account of a young woman's coming of terms with her family, her homeland, her spirituality, and herself.
In presenting Kim Barnes the 1995 PENJerard Fund Award for a work-in-progress by an emerging female writer, the panel of judges wrote that "In the Wilderness is far more than a personal memoir," adding that it stands "almost as a cautionary example of the power of good prose to distinguish whatever it touches." Indeed, In the Wilderness is an extraordinary work, courageous, candid, and exquisitely written.

I have read 2 memoirs about coming of age .......2007-08-30
In the past I have read memoirs about girls growing up 'in the country' and what a challenge it was for them (and their family) This book is a good book to read that covers that theme very well.
Fairness in the face of miracles........2007-02-14
This book is beautifully written, with her early years happening in a kind of Idaho Eden, but what impressed me most was the author's fairness. She presents such a kind, loving, balanced view of the church, her family, their larger church family. She illuminates the glory of charismatic faith and accepts the presence of faith-based miracles. But when she explores what is lacking for her, what was missing as she tried to imagine taking her place as a wife in a Pentecostal family, the reader's heart breaks. Her questioning mind will not let this simple faith stand. As someone with no personal experience with this kind of religion, I was astonished by the rigidity of the church, appalled at how unforgiving a faith supposedly born of forgiveness could be.

A compelling, honest tale full of great surprises.......2006-05-16
I loved this book! Being an avid outdoorsman I ordered it by the title because I expected to learn something of living in the wilderness. In that regard, the book did not disappoint, but there was much more. Kim Barnes also shares an astonishingly honest story of another kind of wilderness - Pentecostal fundamentalism. Having grown up in a very similar religious tradition, I can vouch that her story does not exaggerate. Barnes pulls no punches in revealing human foilables, but without passing judgment on the sincerely held beliefs of others.
Those who enjoy "In the Wilderness," will definitely also want to read "Growing Up Pentecostal" by J. Stephen Conn. Conn's book has a very different setting but also gives a disarmingly honest view of classical Pentecostalism.

This book offers family and friends a glimpse of life with a brain disease.
Carol first knew she was not like other people when she was sixteen years old, however she would not get help until she was forty, despite a family history of mental illness. At the time of her diagnosis the Food and Drug Administration had just approved lithium and life became bearable for her.
In 1994 Carol was diagnosed with Attention Deficit Disorder, often a companion to manic depression. She calls the two illnesses the dynamic duo. Despite her illness she worked 24 years in career positions which she picked carefully to fit her illness.
Hope and understanding are what this book has to offer.

This will help explain a lot of things, most people do not understand this, especially families. How many people in this country, do you think, are being diagnosed wrong, and how can people even make judgements on this. She's right about one thing, the devil does hide in churches.
