Harvard law professor Richard H. Fallon introduces non-lawyers to the workings of American constitutional law. He writes about leading constitutional doctrines and issues, including freedom of speech and religion, the guarantee of equal protection, rights to fair procedures, and rights to privacy and sexual autonomy. Fallon describes many of the fascinating cases and personalities that have shaped constitutional law, demonstrating how historical, cultural, and other factors have influenced constitutional adjudication. Furthermore, Fallon argues that the Constitution must serve as a dynamic document that adapts to the changing conditions inherent in human affairs.

            Book Description

Why and how has the business corporation come to exert such a powerful influence on American society? The essays here take up this question, offering a fresh perspective on the ways in which the business corporation has assumed an enduring place in the modern capitalist economy, and how it has affected American society, culture and politics over the past two centuries. The authors challenge standard assumptions about the business corporation's emergence and performance in the United States over the past two centuries. Reviewing in depth the different theoretical and historiographical traditions that have treated the corporation, the volume seeks a new departure that can more fully explain this crucial institution of capitalism. Rejecting assertions that the corporation is dead, the essays show that in fact it has survived and even thrived down to the present in part because of the ways in which it has related to its social, political and cultural environmental. In doing so, the book breaks with older explanations ground in technology and economics, and treats the corporation for the first time as a fully social institution. Drawing on a variety of social theories and approaches, the essays help to point the way toward future studies of this powerful and enduring institution, offering a new periodization and a new set of question for scholars to explore. The range of essays engages the legal and political position of the corporation, the ways in which the corporation has been shaped by and shaped American culture, the controversies over corporate regulation and corporate power, and the efforts of minority and disadvantaged groups to gain access to the resources and opportunities that corporations control.

              Book Description

This book argues with facts and figures that a small group of New York banks, by means of term loans and working in close collaboration with their affiliated life insurance companies, exerted a strong influence over the supply of money and credit, and thus over the economy, throughout the years of the Depression. This study analyzes the growth of term loan under the depression, the concentration of the loans in a handful of powerful New York banks, the interplay between these banks and large life insurance companies in the capital market, and the resulting economic consequences. It also details the changes that took place in the leadership within the financial hierarchy during the depression: the J.D. Rockefeller interests replaced the Morgan-First National interests as the country's dominant financial power- a change that has escaped previous scholarly notice.
Originally used as a credit instrument to finance distressed corporations during the prolonged depression, term lending by commercial banks gained momentum in the mid-1930s and had, by 1940, accounted for 30-50% of the outstanding loans held by New York, and Chicago banks. Although a number of studies have attempted to explain the significance of term loans in corporate finance during this period, their treatment of the subject was relatively limited in scope due to absence of systematic data on loans provided by individual banks to their corporate borrowers. This study is the first to investigate all the loans reported by the borrowing corporations to the Securities Exchange Commission between 1935 and 1941 and also to make use of the abundant related materials that appear in a wide range of journals and public documents. Contrary to widely held belief, the banking reforms of the New Deal era failed to reduce Wall Street's influence over finance and industry.

              Book Description

An account of the history, structure, and operation of the First and Second Banks of the United States, this study examines how the banks performed as national and central institutions, and what happened to the economy when the charter of the Second Bank was allowed to expire in 1836. Historians have paid little recent attention to the early history of central banking in the United States, and many Americans believe that the Federal Reserve, created in 1913, was our first central bank. The economic crisis during the American Revolution actually led to the founding of a national bank, called the Bank of North America, during the period of Confederation. Although it became a private bank before the Constitution was ratified in 1788, it proved to be such a success that in 1791 Alexander Hamilton, the first Secretary of the Treasury, was able to convince President Washington that a similar bank should be established. While the First Bank of the United States performed well during its tenure, its charter was allowed to lapse in 1811. A Second Bank of the United States was created five years later in 1816, and it prospered under the leadership of its third president, Nicholas Biddle, from 1823 to 1830, when central banking was practiced. This success ended with the 1828 election of Andrew Jackson, who refused to recharter the bank and withdrew the government's funds in 1833. Severely weakened, the Bank continued, but its charter finally expired in 1836, much to Biddle's dismay.

A great read for anyone with an interest in the history of the Bank of the US, or for US history buffs in general. Kaplan explores not only the patterns and general themes of the Bank's development and demise, but also some of the finer points of its history that add character to this intriguing story.

Although the cashless society has been predicted for at least twenty years, the new forms of card-based and software based electronic money may prove to be a partial alternative to the current forms of payment. This study examines these emerging electronic money systems and their possible adoption, primarily in the United States.

                      Book Description

Herbert Hoover, as Secretary of Commerce, and Benjamin Strong, as Governor of the Federal Reserve Bank of New York, played a critical role in the formulation of American monetary policy during the 1920s. Yet little attention has been given to the relationship between them--at first cooperative, then increasingly one of conflict and factionalism--or to the impact of that relationship on policy formulation. This book sheds new light on their roles in policy making and relates those roles to larger conflicts over where policy should be made, how the Federal Reserve System should be structured, and the balance that should be struck between international, national, and regional considerations. Focusing on the Hoover-Strong relationship from a political rather than a purely economic perspective, the book's scope includes both domestic and international aspects of Federal Reserve policy formulation. New sources have enabled the author to provide both fresh details and a broader interpretation. Elaborating on the belief that the Depression resulted from policies developed during the autumn of 1927, the author contends that the foundation for those policies was laid with America's decision to underwrite the Dawes plan, the decision to underwrite England's return to the gold standard, and the involvement in European monetary stabilization--all issues over which Hoover and Strong disagreed.

5 out of 5 stars Silvano Wueschner - Genius. Period. .......2005-09-15

Dearest Reader, do not let the negativity of the previous reviews deter you from giving this wonderful tome a fighting chance. Dr. Wueschner's account of the gripping struggle of early economists to accomplish the things that economists should be expected to accomplish is an enlightening tale for all eight people who are interested in the history of monetary policy. Although he may look exactly like Andy Sippowitz from TV's "NYPD Blue," Wueschner is no boorish dunce, and his works are worthy of careful consideration.

This book is without structure or conceptualization. Monetary policy is an important topic, but the author has not addressed it in a worthy manner. Too many questions are left unanswered. How was monetary policy approached by Strong and Hoover? What were the economic traditions which provided the background for the ideas of each. What are the facts and figures describing what actually was going on in the American economy during the early days of the Fed? The author provides no conceptual framework for the poor reader who has to plow through endless quotations unlinked to any rational argument. This book was totally disorganized.

Wueschner's study of the creation of Federal Reserve monetary policy early in the twentieth century is a carefully thought-out and written exegesis. It is placed in the essential economic context for general readers. Wueschner did not write exclusively for professional economists or professional historians. His work has been widely reviewed in the academic literature. The reviews, as might be expected for a controversial book on a controversial topic, have included both positive and negative comments with nearly every reviewer concluding that Wueschner's work is a contribution to the discipline of monetary history worthy of reading and evaluation by a wide audience. This work has been cited in recent studies that include articles published by the Federal Reserve System. Wueschner's book does not fit into the categories offered by the nameless reviewers who have offered evaluations for Amazon.com to date. It is not the book of the century. Nevertheless, it is not a weakly-written and poorly researched product. The book will stand on its merits and I think it will be part of the monetary history literature when most of what is being published today has been discarded.

                            Book Description

Agricultural markets have entered a long-term process of liberalization, with the aim of reducing imposed market imperfections such as monopolistic public trade, entry barriers and subsidies. The experience of more than a decade of agriculture liberalization offers a good opportunity to review and analyze the outcome of this process and to draw lessons for the future. The central topic in Agricultural Markets Beyond Liberalization is the relationship between market structure and how markets perform in a dynamic context during a liberalization process. The topic is studied from both a micro and macro viewpoint and refers to different types of agricultural markets. This volume brings together the dynamics of agricultural markets in several parts of the world, with a special focus on transition economics and Africa. The different studies cover geographical areas as wide as a district as well as a group of countries, and institutions from individual contracts to multi-national organizations. The analysis of liberalization under different circumstances, and the different methods of analysis used by the authors provide a valuable foundation for the assessment of liberalization.

2 out of 5 stars Better Book - Two Years Sooner.......2006-07-12

Having a great deal of interest in debt relief, I compared the knowledge offered in two similar books. This one, and "The Credit Diet" which was released in 2003. In the latter, there are examples and motivation as in this book. However, with "The Credit Diet" you can see progress almost immediately after you put that "REAL" plan into effect.

Both books do a great job of talking about how to balance finances with the rest of your life, but, I liked the information I got two years before this book was even released.

2 out of 5 stars Didn't find any helpful or practical tips for getting out of debt.......2006-06-18

This is a very general overview of finances. So general, in fact, that I didn't actually learn anything new. She goes from quizzes and philosophies about spending money (Wow, so I am in debt because I like to live above my means, and get pleasure from spending money? Thanks for the newsflash!), and moves on to titheing, saving and investing with no actual stop at "how to get out of debt". If I had money to save or invest I wouldn't have bought a book on getting out of debt.

There is a bit of general info about credit scores and improving your credit rating, but like I said, nothing new to me - and I have a lot of questions about subjects so I was disappointed.

I was hoping for some practical tips and tricks that I hadn't thought of for how to shave down my spending and get out of debt faster. But the best info in here was in the introduction, where she essentially says to make more money and spend less. I just wish I hadn't wasted the hours it took to read this book when the best info was in the intro.

Also, this is a Christian book and that isn't mentioned anywhere on the cover. It covers titheing and suggests joining a church and asking God for help.

5 out of 5 stars Thoughtful and Not Religious.......2006-03-13

I am a Jewish, liberal and loved this book. Don't know what the other reviewers balked at a few religious elements, it seems there may be another agenda, they are so minor in comparison the overwhelming information that is found in this book. I enjoyed the FICO score update, learning a few things in the process. I also like the author's style as upbeat, fresh and clear. There's no sense of pretense. The report card for kids was extremely helpful and insightful as guide to what my children should know at various ages. I think the work ethic element among children is well presented and something that could be easily practiced.
                                      Enjoyed this book.

1 out of 5 stars Simplistic, plus be aware this is a Christian money management book.......2006-03-06

A friend thought I might be interested in this book, so I checked it out of the library to see if it would be worth purchasing. I'm glad I had a chance to look it over for free before making a mistake and purchasing it.

First of all, as an earlier reviewer said, the financial advice in this book is incredibly simplistic. The "quizzes" and checklists are more or less pointless. The actual financial advice she gives (which is surprisingly meager in a book on finances) is completely non-unique and more or less parrots advice given by tons of other authors. Basically, the financial portion of the book is an over-simplified and poorly written copy of financial advice you can find just about anywhere.

Second, this book is a Christian money management book but this is NOT in any way disclosed on the front matter or back of the book. I'm not sure why a money management book would advocate believing in God and joining a local church, but if you get to the third chapter or so, the author states this pretty clearly. If you're not interested in a Christian perspective on money management, this is not the book for you. I think if financial management books are about religious approaches, this should be clearly disclosed on the exterior of the book so that those of us who aren't interested can move on quickly.

1 out of 5 stars Did I read a different book from the other reviewers?.......2005-08-24

I really just didn't find it helpful. In the first chapter she has a 10-question quiz to determine your knowledge of basic financial principals (should you re-fi your home to pay off credit card debt?) and based on those answers, determines whether or not you're in debt trouble. According to her, I'm in great shape! Wonderful! Except...it's not true. I KNOW the principals, I just like to spend. And spend. And spend some more. She also seems to operate on the premise that you own a home - great....unless you don't (I don't). Lots of irrelevent information - 2 full pages of checklists of when to inspect certain things around your home - way off focus. Tell people they need to keep their biggest investment in good repair .... but let them go elsewhere for the details. I could go on but I'm sick of typing. I HIGHLY recommend "How to Get Out of Debt, Stay Out of Debt and Live Prosperously" by Jerrold Mundis - first day I picked this up was Day One of a 4 month stretch of not using a credit card once. Very inspiring.
