    I read the Generic Challenge in one evening. It is easy to read, anecdotal and short (100 pages). My favorite portions of the book were Chapter 2 (pharmaceutical patenting strategy) and Chapter 7 (drug life-cycle management). It is hard to believe that so much information and seasoned advice is packed into this little book.

    Generic Challenge is not written as a reference for experts. Rather, the book is written as an introduction for readers who are new to the field and interested in the topic. Because patents are now so fundamental to the business of pharmaceuticals and biotechnology, I would recommend this book to virtually everyone working in those industries regardless of whether you will deal directly with patents.

    The book is concise, witty, understandable by lay and law people alike, and helpful in understanding the difficulties that innovative drug companies face as well as how generics keep the innovators on their toes. Not designed as a treatise (thankfully), it is helpful for someone who wants a quick and readable overview of patents and drug laws and regulations in the U.S. and elsewhere, and how they affect the incentives to develop new drugs. This is well-suited for people who work at drug companies (whether innovator or generic) and among the professionals that serve those companies, not to mention politicians and others who make or influence policy, or anyone who wants to be informed about the facts and policies that underlie the "generic" debate that plays out in the press.

    Pages 1-40 disclose some background information relating to patents. Here, the author is plainly uncomfortable with the topic. Pages 41-107 describe various regulations relating to FDA submissions. Here, the writing is somewhat more assured.

    On page 14, the author states that "claims tend to get long winded because for some reason lost in the mists of time, there can only be one sentence in each claim, so that [sic] sentence sometimes gets very long." This is false. A basis for single sentence claims is the Patent Act of 1836, but also in a publication from July 1836 called "Information to Persons Having Business to Transact at the Patent Office."

    On page 15, the author states that the Seaborg claim is a broad claim. This is false. The Seaborg claim is a species claim (a narrow claim). The Seaborg claim is NOT a genus claim (genus claims are broad claims).

    On page 15, the author states that "the broadest patents have the shortest claims." This is not really true. The author forgets that certain extra words, such as "comprising" or "or", are universally used to broaden claims. Again, the author might have described how "comprising language" is used to broaden claims. The author also might have explained how "or language" is used to broaden claims. But nothing is said about these techniques for broadening claims. Note also that what can be broad is a CLAIM in a patent, not the patent itself. From the writing, the reader might infer that the SPECIFICATION determines whether a patent's coverage is broad or narrow. But this is not the case. An author writing for a novice audience should not be using careless phraseology in referring to established, clearly defined concepts.

    On page 16, the author tries to describe the Doctrine of Inherency, giving the example of a mechanism of action of a drug. This is a confusing example, because there are really two issues going on in this example: (1) Inherency; and (2) Failure to satisfy the utility requirement (35 USC 101). This is also a bad example because often, when faced with a discovery relating only to mechanisms, the patent attorney might draft a claim reading, "A method to detect this mechanism" or "A method to stimulate this mechanism." For the claim given by the author, when written by an attorney to read "A method to detect this mechanism" or "A method to stimulate this mechanism," only utility is an issue (inherency would no longer be an issue). The author should have used the much better example found in a case from the Federal Circuit, In re Cruciferous Sprouts.

    On pages 18-19, the author attempts to explain novelty, utility, and non-obviousness. However, the author only mentions the statute 35 USC 103, and fails to mention 35 USC 102 (novelty) or 35 USC 101 (utility). At this point, it is becoming clear that the "book" is unusually disorganized and inaccurate.

    On page 23, the author states that "A patent is a sword, not a shield. . ." This is false. As soon as a patent is filed, it becomes a powerful shield, as it can become prior art under 35 USC 102(e), preventing the allowance of U.S. patents, e.g., of competitors. Morever, as soon as a patent application is published, it also becomes a shield, preventing the allowance European patents, e.g., of a competitor.

    On page 28, the author tries to explain the "Function, Way, Result" test. But what a mess the author has made. The author writes, ". . . it might infringe under the doctrine of equivalents because your gizmo has an element that performs a similar function by similar means in a similar way . . ." What happened to "Result"? Where is "Result"? Where? The author is further confused here, because he uses the term "means." In patent law, the term "means" is used to invoke 35 USC 112, paragraph six. The term "means" should not be used when initiating an explanation of the Doctine of Equivalents. Another mess.

    On page 31, the author writes, "This is called prosecution history estoppel if you really wanted to know." This type of comment is excessively informal, and is not appropriate for a "book" on patent law.

    On page 89, the author states that "The FDA recently approved a combination of two well-known cholesterol lowering statins giving new life to Merck's Zocor by combining it with a newer statin sold by Schering-Plough." This is false. The compound of Schering-Plough is Zetia. But Zetia (Ezetimibe) is not a statin.

    This "book" contains only about 30,000 words. This is the length of a typical law review article. At $25.00, this tiny "book" is no bargain. The production could be better. While the quality of the glossy cover is excellent, the ink in my copy of the book is smeared on pages 34, 49, 88, 105, and 108. Citations for cases, and the names of cases, are missing (pages 51, 66, 71, 74).

    This "book" contains way too many errors in its attempts to describe various issues in patent law. For this reason, this "book" deserves zero stars.

    The Generic Challenge should be required reading for every pharmaceutical executive. It is a long overdue prescription for an information gap that many in the pharmaceutical industry suffer from, whether they realize it or not. The book provides a clear and concise explanation of the most significant concepts of patent law and FDA regulatory law and the important ways interact to influence product life-cycle management. It also provides a "big picture" view of the current challenging legal and regulatory environment for the development and commercialization of innovative drugs. It is written in an easy-to-read style and does not overwhelm the reader with endless citations to case law or Federal regulations. The Generic Challenge succeeds in being a basic but extraordinarily useful primer on the interface between pharmaceutical patent law and regulatory issues. It is well worth the price.

      I never before in my 28 years have read a book more useless and pathetic than this. The business ideas are a real joke. Hardly any of these ideas could be developed into an real business. Whatever you do DO NOT WASTE YOUR MONEY. You would be better off buying an 1975 map of south Mississippi. It could help you start a business better than this book. I will sell you my copy for [money amount](the cost of a small bundle of fire wood).

      Why You Should Buy This Book:

      If you are really serious about your financial health, here is someone who not only has done the things he teaches you, but who is actually there to help you when you need answers to questions, or individual help.

      If you know anything at all about the usual "courses" and "seminars"....for getting rich in real estate, etc... you know that what happens when you buy them, no matter the quality (or lack of quality!) of the information you are given, you are either left to "sink or swim" or your questions are "answered" by a group of people hired by the course or seminar business to do customer service. Sometimes you are allowed to question the "big guy", but even then, it is usually a "stand-in-line-after-the-lecture" deal.

      IWS is different, because Ty Hicks is different.

      Tyler G. Hicks is a mulit-millionaire; a NewYork kind of guy: he talks fast, talks plain, and doesn't like wasting time.

      I recently saw him criticized by some skeptic who called Ty and insisted on being given "proof" that what Ty teaches "really works". The man was upset because Ty did not want to play that game. But notice: the man WAS ABLE to get Ty Hicks on the phone. That is because, when you call Ty Hicks, you do not get a customer service clerk, or even a secretary... you get Ty Hicks! And Ty did not refuse to help the man make money; Ty refused to waste time "proving" ..for free... that what he has successfully done for over 30 years DOES in fact, work.

      I suspect the reason Ty reacted that way is because if the man had done his homework at all, he would know that what Ty teaches works. A better thing to do would have been to call Mr. Hicks and ask a REAL QUESTION. I'm sure Mr. Hicks would have helped him beyond his wildest dreams.

      I know, because Mr. Hicks helped me, many years ago. At that time, skeptics surrounding me claimed Mr. Hicks would never talk to me, and that I was a fool to even try. Because I was a VERY POOR mother with a bunch of kids; I had zero to offer Mr. Hicks. However, I had bought one of his books and a one year subscription to his newsletter. I had decided to try and find a mentor from the many authors I had read, so I took a chance and called. Mr. Hicks. Imagine my shock when Mr. Hicks himself answered the phone!

      When it became obvious that Mr. Hicks not only would talk to me, but encouraged me to call him back when I needed help....and then DID HELP ME, the skeptics changed their tune to claiming Mr. Hicks was "only trying to make money off of me". At the time I found that hysterically funny. I pointed out that if that were his plan, he wasn't very bright...because at that point, Mr. Hicks was possibly earning pennies an hour ..in book royalties...counseling me! Everything Mr. Hicks did was helpful and ethical and logical. He is an incredibly wonderful person.

      When I called Mr. Hicks, I had actually been on welfare (put on welfare at the insistance of my husband, who then abandoned his kids)...and was living in a town that was in the middle of a depression, with it's major industry shut down. I had six kids, three of them pre-schoolers, no job, and almost no experience.

      I had some ideas, but no courage and no idea how to actually implement them.

      As if he were my brother, Mr. Hicks took time to help me, step by step. Mr. Hicks answered questions I would have thought would have frustrated a successful man like him. My experience with Mr. Hicks is that he is one of the kindest, most generous men I have ever met. In the end, he helped me to purchase a brand new home of my own, with nothing down, begin a child-care business which was to blossom into a chain of child care businesses where the operators were trained and licensed, purchase rental properties and find good renters for them - BEFORE I BOUGHT THEM ....by being a good landlord and giving tenants what they need... and to use venture capital to take over a small energy-conservation company. That's not all Ty Hicks did for me; he is an incredible man. But this gives you some idea.

      Don't get me wrong: Ty Hicks expects the people whom he helps to WORK. Ty Hicks cannot do it for you. He did not waste hours yakking on the phone. Instead, he did something more important: HE HELPED ME LEARN HOW TO MAKE THESE THINGS HAPPEN FOR ME! I believe: if there is anyone in the entire world - besides you - who can teach you how to become rich - ethically - Ty Hicks is the man.

      You have to ask yourself: why did Ty Hicks do this for me? I was a complete stranger; I did not even have a job, and I lived thousands of miles away from Mr. Hicks. Those who have actually gone and taken action to learn and do what Ty Hicks teaches know why. If you want to find the answer; if you REALLY WANT to become wealthy and are seriously willing to do what it requires, I suggest you follow a route explained by Ty Hicks!

      The 3 reasons not to buy this book:

      1. The earnings potential in this book are very unrealistic. It seems as if you can be rich with almost no work.

      2. Some of the business concepts are absurd(i.e. a service that uses dogs to chase ducks away from your property)

      3. The author does not have your success in mind, he just wants to sell you his books and newsletters.

      I took Hicks up on his offer to speak with him on the telephone. I was impressed that he would actually make his telephone number available, and would answer it himself. I had called to discuss one of his "kits". In a very amicable manner I asked Mr. Hicks for some way that I could verify his claims. Instead of responding helpfully, he said "I'll still eat tonight if you don't buy my information". He treated me like a dolt. Needless to say, I did NOT purchase anything more from him.

          This is a good book if you have a toddler or younger child.
          and also it is good if you have NO experience being frugal and have never heard of discounts, etc...
          I suspect the author is married to a guy with a good job and he makes a lot more money than my husband does, I also suspect that they own a nice home, and aren't struggling to come up with a downpayment on a home.
          Its easy to be a stay at home mom when Dad earns a lot.
          maybe her idea of cutting back means on the dinner parties and expensive jewelry
          a good book for the yuppie set.

          I really read this book, unlike the authors friends who posted here and clogged up the true review space with false praise

          I really like this book - it gives you the knowledge you need to know to make changes in your budget, expectations, etc. Topolnicki really knows her stuff, and delivers the message in a user-friendly manner. I recommend this book to all parents who want to cut back to one income.

          The purpose of this very readable book is to allow a parent to spend more time with their children. The author used her experience in financial journalism to calculate expenses. After surveying more than 100 mothers, she then wrote this book to help other families with young children survive on one income. Most mothers are at home when their children are young. Whatever your reason, this book can help you to spend less on living expenses without pain.

          This book has four parts. One) to help you analyze your present financial situation and plan for the future. Two) has hundreds of tips to help you cut spending. Three) shows how to save more while earning less. Four) tells you about work: quitting & keeping benefits, part-time work, and how to resume full-time work.

          I've been doing a lot of research on whether or not it will be feasible for me to either quit my job or cut back to part-time. And while I truly appreciate all the books out there about how to clip coupons and make my own granola, this book is different. Ms. Topolnicki gives financial advice on cutting back from two incomes, starting with tax savings and going all the way through to saving on groceries and entertainment. This is serious, real-life stuff. Her chapter on investing alone is worth the price of the book. Taxes, investments, savings, insurance, groceries, vacations, entertainment -- they're all covered and MORE! This is the first book I've read on the subject that gives me REAL hope that I can plan a budget on less than the two incomes we've gotten used to in the past ten years. I can't say enough about this book and the strategies that are outlined therein. Buy it, or borrow it from the library today.

          Denise has hit the nail on the head. Although everyone will find much they already knew (but might have forgotten), almost everyone will find new insights as well. Denise's straightforward and personal writing style communicates that she's not just making this up, she's telling what she knows from experience. Few people are as well qualified to discuss this subject. If this topic is even slightly of interest to you, you'll want to read this book.
