Book Description
Violence, Conflict, and World Order: Critical Conversations on State-Sanctioned Justice examines the interpersonal, institutional, and structural relations of injustice and violence, both domestically and globally, through a series of dynamic conversations that are rich with personal and passionate prose, gritty and grounded questioning, and, in several instances, spirited and lively debate. These conversations are attentive not only to the areas of cultural studies and social science in general, but also to the studies of criminology, criminal justice, and public policy in particular.

Book Description
Examines nation-building efforts in such countries as Iraq and Afghanistan, and assesses the success of U.S. and allied efforts in reconstructing internal security institutions.
Customer Reviews:
Highly recommended for it's concise, thorough, and scholarly presentation of the modern reconstruction process .......2006-06-06
Collaboratively co-authored by the team of Seth G. Jones, Jeremy M. Wilson, Andrew Rathmell, and K. Jack Riley, and enhanced with the inclusion of an extensive bibliography for further study and reference, Establishing Law And Order After Conflict is a 261-page seminal study of the post-Cold War reconstruction and international security forces, in terms of establishing a post-conflict justice system in the aftermath of oppressive authoritarian governments and what were often brutal and bloody conflicts. Offering a descriptive interpretation of the efforts involved in rebuilding economically, politically, and physically on a national level for countries such as Kosovo, Iraq, and Afghanistan, Establishing Law And Order After Conflict delves deeply into an informed analysis of conflict and reform aimed at providing a much needed foundation for restoring national security. Establishing Law And Order After Conflict is very highly recommended for it's concise, thorough, and scholarly presentation of the modern reconstruction process in societal, economic, and cultural stabilization of impoverished and conflicted countries.

Book Description
Prisons remain a controversial topic for debate in our society. While few doubt the necessity of their existence, there is considerable debate over their purpose, organization, and processes. Do prisons exist to rehabilitate, punish, or simply incarcerate? How do we judge prison conditions? If those conditions are found to be unacceptable, how do we change them? What are a prisoner's rights?
This book charts the history of Rhode Island's Adult Correctional Institutions over the past 40 years. Professor Carroll examines the radical transformation of Rhode Island prisons in response to changes in their external environment, and determines that the transformation can be seen to manisfest five distinct stages: patriarchy, anarchy, restoration, threat, and consolidation.

Book Description
The relationship between international order and justice has long been central to the study and practice of international relations. For most of the twentieth century, states and international society gave priority to a view of order that focused on the minimum conditions for coexistence
in a pluralist, conflictual world. Justice was seen either as secondary or sometimes even as a challenge to order. Recent developments have forced a reassessment of this position.
This book sets current concerns within a broad historical and theoretical context; explores the depth and scope of this presumed solidarism amidst the difficulties of acting on the basis of a more strongly articulated liberal position; and underscores the complexity and abiding tensions inherent
in the relationship between order and justice. Chapters examine a wide range of state and transnational perspectives on order and justice, including those from China, India, Russia, the United States, and the Islamic world. Other chapters investigate how the order-justice relationship is
mediated within major international institutions, including the United Nations, the World Trade Organization and the global financial institutions.

The Culture of Control: Crime and Social Order in Contemporary Society
ASIN: 019511289X |
Book Description
Most Americans are not aware that the US prison population has tripled over the past two decades, nor that the US has the highest rate of incarceration in the industrialized world. Despite these facts, politicians from across the ideological spectrum continue to campaign on "law and order"
platforms and to propose "three strikes"--and even "two strikes"--sentencing laws. Why is this the case? How have crime, drugs, and delinquency come to be such salient political issues, and why have enhanced punishment and social control been defined as the most appropriate responses to these
complex social problems? Making Crime Pay: Law and Order in Contemporary American Politics provides original, fascinating, and persuasive answers to these questions.
According to conventional wisdom, the worsening of the crime and drug problems has led the public to become more punitive, and "tough" anti-crime policies are politicians' collective response to this popular sentiment. Katherine Beckett challenges this interpretation, arguing instead that the
origins of the punitive shift in crime control policy lie in the political rather than the penal realm--particularly in the tumultuous period of the 1960s.

A Short Guide to Legal History.......2006-02-01
The author is a law professor, attorney, and social scientist (Ph.D. in political science). The 100 people in this book were selected as those who had "the most impact on" the evolution of Anglo-American law. Not all of the people listed here are lawyers. Lawyers have played an important role in bringing democracy, individual freedom, and economic prosperity; sometimes at great personal sacrifice. This list was derived from law professors at American law schools. The ranking is by the author alone. The 'Preface' explains his choices. Most of the people listed here led lives that could make interesting films. This book is written for a general audience. Placing these people in historical order would be more educational.
The 'Introduction' provides "A Brief History of Western and Anglo-American Law" in 25 pages, the most important part of this book. The beginnings of Western civilization are generally attributed to the Sumerians, the land between the Tigris and Euphrates. Hammurabi's code is the oldest complete law code (p.2). The Hittite law code is another complete corpus juris. Modern law codes differ in degree rather than kind. They are concerned with interpersonal relationships and property regulations. The Jewish Bible reflects Babylonian law, and these concepts were carried over to Christianity. The problems of Athens resulted in rewritten laws by Solon. The new Roman republic resulted in new laws, the Code of the Twelve Tables, which are lost to us (p.4). The Romans invented the idea of a judge and a lawyer for each side. The idea of natural law from classical times informed the English common law which is in use today (p.5). Justinian reorganized the laws for the modern times of the sixth century AD; this formed the basis for the laws on the continent.
The 'Dark Ages' saw the codification of feudal law, where leaders gave goods to supporters in return for loyalty (this describes politics today). The Roman Catholic Church developed its Canon Law which influenced national laws (p.6). Kings attacked the jurisdiction of Church courts to expand their own power (and collect the fines). Lord Chancellors developed the idea of doing what was fair and equitable for people (p.9). The ideas of Locke and Montesquieu are reflected in the U.S. Constitution. The American Revolution is marked by the Declaration of Independence; most of the signers were lawyers (p.12). Three brilliant lawyers worked out compromises for the Republic (p.13). [McWhirter doesn't tell you that the "right to privacy" was invented to stop publishing photographs of the rich and powerful (p.18). And that corporations like the Rockefellers and Carnegies were behind Prohibition (p.16).]
Regulation of business was started by Disraeli when the excesses of capitalists harmed the powerful British aristocracy (p.19) [who still own most land in England]. Theodore Roosevelt passed anti-trust and regulation of giant monopolies. The 1950s and 1960s saw new protections for people's rights (p.20). [The Miranda Warning was a return to older standards.] The end of Napoleon was followed by multinational treaties (p.22). Many lawyers helped to safeguard legal rights for the accused (p.23). Legal systems tended to regulate business and protect consumers and the environment. Other political questions are listed on page 25.
If you have read about some of the 100 people you would know the few pages omit much. Erle Stanley Gardner (and others) founded 'The Court of Last Resort' to free the wrongfully convicted. His novels educated the public about the law and the need for forensic sciences. The author's selection of #100 suggests something about both of them.
Can society, or humans, be improved if only laws were changed? Did Prohibition work? Does political freedom require economic freedom? Can we have democracy when most people are poor and 2% are super-rich? Would fewer laws result in a happier society? If things were "better" in the 1960s was it the laws of the economy? Can humanity ever be happy?
An interesting look at the figures who shaped jurisprudence.......2001-10-01
It offers a top 100 legal list of attorneys, jurists, judges, statesmen, philosophers and political theorists through the ages that have a profound influence on Western Jurisprudence. The Legal 100 places a particular emphasis on Anglo-American law. I guess this book is fairly balanced ideologically. Though, it has quite a few figures who organized the law for the purpose of 'legal plunder.' Granted, they've had a profound influence on contemporary law too. It is probably one of those books like Black's Law Dictionary, that every student of law should have. My only gripe is that the classical liberal statesmen and economist, Frederic Bastiat, was not included.
Sampling of the top 50: 1. James Madison; 2. Alexander Hamilton; 3. John Marshall; 4. Cicero; 5. Daniel Webster; 6. Clarence Darrow; 7. William Mansfield; 8. Thomas Eskine; 9. Edward M. Hall; 10. Earl Warren; 11. Edward Coke; 12. Francis Bacon; 13. William Blackstone; 14. James Kent; 15. George Wythe; 16. John Locke; 17. Montesquieu; 18. Olier Wendell Holmes; 19. Louis D. Brandeis; 20. John Marshall Harlan; 21. Aristotle; 22. Jeremy Bentham; 23. John Stuart Mill; 24. John Austin; 25. Karl Marx; 26. Earl Rogers; 27. Charles Evans Hughes; 28. Hugo Black; 29. William O. Douglas; 31. Hammurabi; 32. Solon; 33. Justinian I; 34. Henry II; 35. Edward I; 36. Napoleon Bonaparte; 37. Benjamin Disraeli; 38. William Gladstone; 39. Theodore Roosevelt; 40. Woodrow Wilson; 41. Franklin D. Roosevelt; 42. Lyndon Baines Johnson; 43. Christopher Langdell; 44. Roscoe Pound; 45. Benjamin Cardozo; 46. Lemuel Shaw; 47. Mary Wollstonecraft; 48. William Godwin; 49. Mohandas Gandhi; and 50. Susan B. Anthony. Other luminaries included are: Thurgood Marshall Edmund Burke, Patrick Henry, Thomas Jefferson, Joseph Story, John C. Calhoun, Otto von Bismark and V.I. Lenin.

From the author: This paper develops a model that captures important features of debt crises of the Brazilian type. Its applicability to Brazil lies in the facts that (1) macroeconomic fundamentals were relatively sound in the wake of the crisis (e.g., a nonnegligible primary surplus, a relatively low debt-GDP ratio, and low inflation); and (2) the trigger for the crisis--forthcoming elections with an expected regime change--appears to be extraneous. We rationalize the sort of circularity involved in a country's credit rating. In particular, we show how country credit ratings could bring about unstable macroeconomic behavior, and explore the implications of such behavior for fiscal policy. [JEL F21, F34, G15]

From the author: In the early nineties there was a significant recovery of many debt-ridden economies after the shift in debt policy implicit in the so-called Brady Plan. Yet, the use of scarce resources from debtor countries to buy back part of their debts remains a controversial feature of this Plan. We use a multiperiod model of debt overhang to show that, under asymmetric information, this transfer of resources emerges naturally as part of the shift from a strategy of debt rescheduling, to one of debt reduction.

From the supplier: The relationship between the composition of outstanding federal debt and the term structure of interest rates has been a much studied and debated subject. This note examines the relationship between the excess holding period returns and the composition of debt over the post-Accord period. The evidence fails to support a link between debt composition and excess period returns. (Printed by permission of the publisher.)

Book Description
Have bankrupts committed a mortal wrongdoing? The fundamental ethical problem in bankruptcy is that insolvents have promised to pay their debts but can not keep their promise. The Ethics of Bankruptcy examines the morality of bankruptcy. The author explores ethical concerns raised by forgiveness, utilitarianism and distributive justice and the moral aspects of insolvents' contractual, fiduciary, tortious and criminal liability. This is the first comprehensive study that employs the tools of ethics to examine the controversies surrounding insolvency, which makes valuable and sometimes controversial reading in a decade recovering from the Recession. This text compares and contrasts the Humean doctrine of promises as useful conventions with the Kantian view of autonomous agency constituting promissory obligations. Finally, the author assesses recent bankruptcy law reforms, examining British and European modes of dealing with bankruptcy as opposed to American methods.
