    Book Description

In the first half of the fifth century, the Latin-speaking part of the Roman Empire suffered vast losses of territory to barbarian invaders. But in the Greek-speaking half of the Eastern Mediterranean, with its capital at Constantinople, there was a stable and successful system, using Latin as its official language, but communicating with its subjects in Greek. This book takes an inside look at how this system worked in the long reign of the pious Christian Emperor Theodosius II (408-50), and analyzes its largely successful defense of its frontiers, its internal coherence, and its relations with its subjects, with a flow of demands and suggestions traveling up the hierarchy to the Emperor, and a long series of laws, often set out in elaborately self-justificatory detail, addressed by the Emperor, through his officials, to the people. Above all, this book focuses on the Imperial mission to promote the unity of the Church, the State's involvement in intensely-debated doctrinal questions, and the calling by the Emperor of two major Church Councils at Ephesus, in 431 and 449. Between the Law codes and the acts of the Church Councils, the material illustrating the working of government and the involvement of State and church, is incomparably richer, more detailed, and more vivid than for any previous period.

      Book Description

How can property rights be protected and contracts be enforced in countries where the rule of law is ineffective or absent? How can firms from advanced market economies do business in such circumstances? In Lawlessness and Economics, Avinash Dixit examines the theory of private institutions that transcend or supplement weak economic governance from the state.

In much of the world and through much of history, private mechanisms--such as long-term relationships, arbitration, social networks to disseminate information and norms to impose sanctions, and for-profit enforcement services--have grown up in place of formal, state-governed institutions. Even in countries with strong legal systems, many of these mechanisms continue under the shadow of the law. Numerous case studies and empirical investigations have demonstrated the variety, importance, and merits, and drawbacks of such institutions.

This book builds on these studies and constructs a toolkit of theoretical models to analyze them. The models shed new conceptual light on the different modes of governance, and deepen our understanding of the interaction of the alternative institutions with each other and with the government's law. For example, one model explains the limit on the size of social networks and illuminates problems in the transition to more formal legal systems as economies grow beyond this limit. Other models explain why for-profit enforcement is inefficient. The models also help us understand why state law dovetails with some non-state institutions and collides with others. This can help less-developed countries and transition economies devise better processes for the introduction or reform of their formal legal systems.

        Book Description

Denial of justice is one of the oldest bases of liability in international law and is examined by Jan Paulsson in this book. The possibilities for prosecuting the offence of denial of justice have evolved in fundamental ways and it is now settled law that States cannot disavow international responsibility by arguing that their courts are independent of the government. Even more importantly, the doors of international tribunals have swung wide open to admit claimants other than states: non-governmental organizations, corporations, and individuals, and Paulsson examines several recent cases of great importance in his book.

            Book Description

In a lucid, concise volume, Jeremy Waldron defends the role of legislation, presenting it as an important mode of governance. Aristotle, Locke and Kant emerge as proponents of the dignity of legislation. Waldron's arguments are of obvious importance and topicality, especially in countries that are considering the introduction of a Bill of Rights. The Dignity of Legislation is original in conception, trenchantly argued and very clearly presented, and will be of interest to a wide range of scholars and thinkers.

The ultimate justification for the topics covered in this book might be that it recognizes certain disagreements about how law ought to be applied, that certain questions might be raised with any authority that seeks to apply laws in a manner which, according to Lon Fuller, seems to violate "practical wisdom applied to problems that may broadly be called those of social architecture. St. Thomas Aquinas stands for many as a kind of symbol of all that is dogmatic and theological in the tradition of natural law. Yet as one writer has recently pointed out, Aquinas in some measure recognized and dealt with all eight of the principles of legality discussed in my second chapter." (pp. 241-2). If anything, trying to impose morality on an enterprise as quixotic as the law is more likely to meet with indifference today than ever, and already in Chapter IV of this book, Fuller admitted that scholars could mean him when discussing "Law and Morals" and complaining: "Again, if this is what the necessary connexion of law and morality means, we may accept it. It is unfortunately compatible with very great iniquity." (p. 154). Just thinking about very great iniquity reminds me of what most people think prosecutors are for, and in the interest of harmony in the marketplace, I will make no further comments on this book. If only the law could always be so lucky.

3 out of 5 stars Notes for a Longer Book.......2002-12-19

I don't know why The Ages of American Law is regarded as a classic of American legal history. It's clearly written but tries to cover way too much ground in a very short space (111 pages of text with large print and big margins). Based on a series of lectures, The Ages of American Law strings together short observations on legal topics ranging from Lord Mansfield to the development of the Uniform Commercial Code. No subject is developed in depth: at best, the "book" is notes for a real book. One of my professors at law school used to rave about this book. It must have been because he's mentioned favorably in an endnote.

4 out of 5 stars engaging intellectual history.......2001-01-22

A very interesting history of American law, useful for those about to enter the legal profession or enroll in law school, or anyone wishing to learn more about the history of ideas in law.

              5 out of 5 stars A concise classic........2000-04-09

When Lawrence M. Friedman wrote his landmark "A History of American Law," he remarked that American legal history has been a neglected field. Some progress (although not enough) has been made in the field since Friedman published his History in 1973. Part of that progress has been the publication of Grant Gilmore's little book, "The Ages of American Law," which is justly considered to be a classic. The book is based on the lectures Gilmore gave during the 150th Anniversary of Yale Law School for the Storrs Lecture Series in 1974. Although "The Ages of American Law" is an "expanded" version of the Storrs Lectures, the book is still remarkable for its concision as well as for its clarity. Gilmore does not purport to offer an authoritative history of American law in the same vein as Friedman's History. Rather, he captures the grand sweep of history and condenses it into a gem of 154 pages. It remains in print nearly twenty-five years after first publication for good reason-it is well worth reading.

This new examination of the region of Nebuchadrezzar II of Babylon (605-562 BC) includes revised interpretations of the Babylonian Chronicles for his reign, especially for the years of the campaigns against the West and the capture of Jerusalem. Excavations at Babylon are used to give a view of the city in Neo-Babylonian times, including the royal `Hanging Gardens' and the ziggurat. The varied literary genres current in this city of learning in the sixth century BC (including dreams and prophecies) and the role of hostages, exiles, and prisoners of war are used to throw light on the life of the Jewish exiles there. An assessment of the character of Nebuchadrezzar as a military and political leader, religious devotee and legal administrator is attempted on the basis of textual evidence.

Judith Shklar, recently deceased, wrote this book in 1964 to disprove the legitimacy of law based on legal positivist notions. According to Shklar, law is not based on the evolution of antique writings, but is simply an extension of politics.

                      Book Description

This book by leading researchers presents a critical review of debates in environmental social science over the past decade. Three broad areas are covered in ten chapters: the problems of scientific uncertainty and its role in shaping environmental policy and decisions; the development of institutional frameworks for governing natural resources; and the link between economic and technological change and the environment. The book begins with an overview essay examining how perspectives across environmental social science have shifted over the past decade and looking forward to the emergence of new research agendas.

                              5 out of 5 stars Long-Term Investment.......2003-03-20

This is one of the best common-sense books for people who work in a corporation that has ever been written. Many things that are common-sense are not necessarily things we're aware of in the work-place. It's primarily geared to people in sales. But it provides invaluable needed points on the peripherals to success in sales, relations with co-workers and management, and fine-tuning your sales career's ups and downs. If things occur that are bad or good, we need to accurately identify the reasons why. Then take the best approach in dealing with it.

It's easy to overlook the many things we assume are peripheral but actually are integral to our sales and work environment.

The structure of the book is very convenient for the reader. This book doesn't need to be read front-to-back, and the subject your searching for can be found quickly. Its' table of contents with 18 chapters containing sub-topics are categorized in an easy-to-find way to jump straight into the topic you want to read about.

Some of the chapters list and explain many points to consider when choosing a company to work for as an Account Executive. What are the criteria for you to stay or leave a company? How should a salesperson handle enormous success at a corporation? A terrible sales slump? If your loyal to a manager who is shafted what do you do, if anything? Solutions to stress. How do we recognize burnout and defeatist behavour in our lives that affect our performance, and what do we do about it? Sales positions are less political than other jobs in corporations, but one must be at least cognizant of the peripheral politics.

"Guide to Greatness in Sales" appears to get less attention than other works by Tom Hopkins, but it contains unlimited amounts of invaluable and practical information. Many of the topics both good and bad, I've had first-hand experience with (as anyone), and assuring yourself of looking at a situations objectively and then taking the best course of action, is why this is so helpful.

After you finish it, it'll be a good idea to keep it on the shelf where it's accessible. As time goes on this can be a valuable reference for things that we need to remain aware of.

5 out of 5 stars Excellent Advice Regarding the Game Within the Game.......2000-11-07

Hopkins shows you how to avoid or cope with the things that cause salespeople to burn out. Attitude, planning, organizing yourself will all help you become a winner in the sales game.

Written in a refreshing, humorous style, it nonetheless focuses on a very serious side of the sales business which is often glossed over or ignored outright . The advice is wise, priceless, and insightful. Written by someone who clearly has "been there, done that."
