    Book Description

The Treatise of Legal Philosophy and General Jurisprudence is a comprehensive treatment of the issues in legal philosophy and general jurisprudence. This major reference work will consist of a Theoretical Part, 5 volumes, to be published in 2005, and a Historical Part, 6 volumes, scheduled to be published by the end of 2006.

The work is aimed at jurists and at legal and practical philosophers. The theoretical part covers the main topics of contemporary debate. The historical volumes account for the development of legal thought from ancient Greek times through the twentieth century.

Volume 1: The Law and the Right, a Reappraisal of the Reality that Ought to be
    by Enrico Pattaro

This work brings out and recovers the normative dimension of law, called "the reality that ought to be", placing within this reality the idea of what is right. Part I reconstructs the current as well as the traditional civil-law conception of the reality that ought to be and raises some critical theoretical issues. Part II introduces some basic concepts on language and behaviour and presents a conception of norms as beliefs. Part III aims to find explanations for the idea of a reality that ought to be. Part IV consists of inquiries focussed on Homeric epic, the natural-law school, and the normativistic view of positive law.

    Volume 2: Foundations of Law
    by Huber Rottleuthner

This volume focuses on legally external foundations of law by which the origin, the development and the functions of law are explained. Such external variables might be found in mythology, religion, in extra or intra human nature, in the economy, moral attitudes and beliefs, societal conditions, etc. Besides these "explanatory" foundations, which include restrictive conditions of law, foundations are also interpreted in the sense of basic legal concepts, of epistemological foundations or of a normative basis of law.

Volume 3: Legal Institutions and the Sources of Law
    by Roger A. Shiner

This volume investigates the sources of law and focuses on how legal sources actually function analytically within legal systems to create law. It examines how sources such as legislation, precedent custom, delegation, codes or constitutions directly generate validity for legal norms, or how these sources are authoritative for legal decision-making. The book considers the contextual or strictly institutional authority of law and emphasizes sources of law within the common law tradition.

Volume 4: Scientia Juris, Legal Doctrine as Knowledge of Law and as a Source of Law
    by Aleksander Peczenik

Legal doctrine has faced repeated criticism, not least from minimalist philosophers. The author proposes a "Copernican revolution" in the way of understanding the relation of legal theory to philosophy. Instead of attempting to make legal theory follow one of the notoriously controversial moral theories, we can try to adjust philosophy to legal theory. In the search for a philosophy adjusted to legal doctrine, cautious philosophical positions are preferred to daring ones.

Volume 5: Legal Reasoning, A Cognitive Approach to the Law
    by Giovanni Sartor

Legal Reasoning is an application of a broader human competence, practical cognition: the ability to process information in order to come to appropriate determinations. Thus we need to bring to bear on legal reasoning the various studies which address the phenomenon of practical cognition and we need to view the different aspects of legal thinking as elements of a unitary cognitive process.

      Book Description

The concept of global justice makes visible how we citizens of affluent countries are potentially implicated in the horrors so many must endure in the so-called less developed countries.

Distinct conceptions of global justice differ in their specific criteria of global justice. However, they agree that the touchstone is how well our global institutional order is doing, compared to its feasible alternatives, in regard to the fundamental human interests that matter from a moral point of view.

We are responsible for global regimes such as the global trading system and the rules governing military interventions. These institutional arrangements affect human beings worldwide, for instance by shaping the options and incentives of governments and corporations. Alternative paths of globalization would have differed in how much violence, oppression, and extreme poverty they engender. And global institutional reforms could greatly enhance human rights fullfillment in the future.

The importance of this global justice approach reaches well beyond philosophy. It helps ordinary citizens evaluate their options and their responsibility for global institutional factors, and it challenges social scientists to address the causes of poverty and hunger that act across borders.

The present volume addresses four main topics regarding global justice: The normative grounds for claims regarding the global institutional order, the substantive normative principles for a legitimate global order, the roles of legal human rights standards, and some institutional arrangements that may make the present world order less unjust.

      Book Description

This new book reflects Derrida's latest views on the role of education and international organizations in an era of globalization. In this book, Derrida develops a notion of the global citizen that is uniquely post-Kantian. He looks especially at the changing role of UNESCO and similar organizations at a time when individual and national identities, knowledge and commerce, and human rights all are brought to world attention in new ways than they have been in the past. Following Derrida's writings on these issues, prominent scholars engage in a dialogue with him on his approach to understanding the ethics of international institutions and education today. Derrida contributes to the form of focus with his unveiling of new philosophical concepts. In this book, the Sum Lata Dumo is further evaluated, a common theme in meso-constructionist ethics. Derrida argues that all life began in one of two categories, the "Racha" which has all of life including insects and the "Dena" which only includes those things with palpable cognitive abilities such as crickets and hamsters. This book is dense and tough going but it is definitely a continuation of all Derrida's plasmatic themes and even has some of his more congested ones.

Right now my family and I are in Wuhan, China, teaching English. I had The Language of Business English recommended to me as a complete course - as it contains both teacher's notes and exercises on pages facing each other. On going through this volume we are grateful to have a course that will enable us to teach for some time. Travelling with a child has made it very difficult to prepare much. This will be a fact of life for many travelling English teachers.

If anything the exercises need slightly more examples. As a fluent English speaker I at times look at them and wonder what the author actually wants. But perhaps that's just a realistic reflection of everyday life, which a ESL student will have to come to grips with in the real world.

        5 stars, highly recommended.

        1 out of 5 stars Title (partially) a Misnomer.......2001-05-22

The Language of Business English is divided into three sections. The first section is devoted to grammar and covers 159 pages - the majority of the book. Part 2, 'Functions', contains some 42 pages. Then follows 4 pages of dictionary-type appendices followed by a Key and Index. Each section comprises a one- (or two-) page explanation section which follows the format 'Sample Sentences - Form - Uses', followed by a 'Task' section which follows the format 'Exercise 1, Exercise 2, Exercise 3, (Exercise 4) and Transfer'. Frankly, the exercises are dreary in their lack of imagination: gap-fills, lexical substitutions, sentence re-writes etc. The so-called 'transfer' invariably comprises the instruction "Write four examples of..." or something very similar. The authors say that this book is aimed at "intermediate level or above". This raises a few questions. If we consider 'advanced' level to be not too far off from native speaker competence, then certainly the vast majority of business students at "intermediate level or above" have been subjected to virtually all of the content of this book ad nauseum. What they need to make the transition from 'intermediate' to 'advanced' level are native speaker-like lexico-grammatical frames, stems, structures etc. that fall entirely outside the range of this essentially very traditional grammar book. And, frankly, those students who DO need to learn, for example 'the future with going to'(Unit 9), 'the passive'(Unit 23), 'so versus such'(Unit 56) etc. etc., are likely to have major problems with the explanation page of each unit. (E.g. "Already and yet both provide a frame of unfinished time; the time frame starts at an unspecified point in the past and continues to the present." p.14) The title of this book is "The Language of Business English: grammar and functions". We're being deceived here: the subtitle of the book is more indicative of the book's content. While lexis we may tend to associate with business is used in examples (e.g. "He said that they had signed the contract." p.84"), this is effectively yet another sterile grammar book. The small 'Functions' section contains nothing that one cannot find in any other similar grammar book. As for 'The Language of Business English'? Well that's another area entirely.

I did my Masters dissertation on 'outdoor adventure' sport tourism and I got really fed up with the Noddy books that were available to me (eg Standeven and DeKnop "Sport Tourism", Hudson "Sport and Adventure Tourism"). Now I'm starting a part-time PhD on sport tourism this book has enabled me to really think theoretically and conceptually about the area, its the only book I've come across that doesn't treat the topic in a really basic manner. The book goes beyond the usual impacts and events material to develop an analysis of industry stakeholders and the pariticipants in the sport tourism industry. The model of sport tourism participants is particularly useful in thinking about different types of sport tourists. Throughout the book its clear that the authors are drawing on a wide range of empirical research, and their perspectives and arguments are coherent and consistent. In fact, the cohenrence of the book is one of its strengths and something that elevates it above many other books in the area, particularly those that are edited collections.

        Book Description

When he was 26, Chip Conley broke the two cardinal rules of starting a business: he invested in an industry about which he knew nothing and he ignored the mantra "location, location, location." He bought a notorious "pay-by-the-hour" motel in a seedy San Francisco neighborhood.

A dozen years later, Chip is the "boy wonder" of the American travel industry, famous for his entrepreneurial genius, creativity, and sense of fun.

In The Rebel Rules, Conley shares his success secrets. He focuses on the primary traits -- vision, passion, instinct, and agility -- that characterize today's fast company leaders. His guidebook doubles as a toolbox for anyone -- whether a virgin entrepreneur or a corporate manager -- who wants to walk in step with today's business innovators.

The Rebel Rules will show you how to:

With exercises and activities that will develop these and other business skills, The Rebel Rules will transform the way you approach your career.

5 out of 5 stars Why companies need more rebels..........2007-08-31

This is a book that would deserve much more attention by media and readers than it has gotten since it was published in 2001. The reason for this?

It is quite simple; the book goes to the core of a key issue: succeeding in what you do with your professional life while being yourself.

Too many times we seem to be bound to live a life in which compromises are unavoidable in order to make it in our work: there is a "system" and we need to rapidly understand it and find ways to fit in even if this fitting in does not bring to us much pleasure nor pride.

Chip Conley is a successful entrepreneur in the hospitality and entertainment business. He has found success by being a rebel according to his definition of the concept: expressing the best of yourself in order to create value and not caring too much about what the rules of the "system" and "standard practices" are. From his perspective being a rebel does not mean to simply systematically fight what is conventional, it means to find out who you really are and put your talents and ideas to work in order to generate concrete value added within ever changing market dynamics. He also points out that "the rebels who make a difference in the long run are those with integrity" and Conley defines integrity in a very practical way "knowing what to do, saying you are doing it and then doing it".

Vision, passion, instincts and agility (and their balancing act)

Vision, passion, instincts and agility: these are the four key aptitudes that any rebel should discover within, cultivate with method and express in a determined yet balanced and resourceful way. Conley summarizes the concept with an image: your eyes fuel the vision; your hearth the passion; your gut the instincts and your feet the agility.
Vision is what gives us a sense of direction, a way to channel our energy and ideas in order to make a better future for us and other people; passion is the fuel that keeps us going, in order to never run on empty it is essential to focus on the concept of integrity above mentioned and to synchronize who you are, what your values are, and what you do; instincts are represented by the ability to swiftly catch and create opportunities in order to fulfill your vision (Conley makes and interesting point here: while traditional managers are resource-driven - they do what they can with the resources at hand; the rebel managers are opportunity-driven - they don't let themselves be trapped in their thinking by the boundaries of their resources and this helps them to constantly find opportunities for development and improvement); finally agility concerns our ability to keep our material and immaterial (thoughts, assumptions, certainties) baggage light in order to move rapidly at the pace required by the changes happening around us.

This is the theoretical framework, it flows and it makes sense. The tough practical issue is how to integrate all of these four aptitudes by balancing them, Conley points out: "Few people - rebels or not - posses all four qualities in full measure. Great eyes (vision) but awkward feet (agility) will lead to embarrassing organizational moments. A big heart (passion) but a confused gut (instinct) means a lovable but indecisive leader. A rebel out of alignment can create dis-ease not only in the rebel's body but also throughout the organization. Just like any athlete, the rebel may favor certain body parts. But she can also develop her abilities, and when she combines al of four aptitudes in choreographed manner, the result is pure poetry".

"The rebel's job is to make the complex simple"

This sentence captures the essence of Conley's message. The balancing act of the rebel's four core aptitudes should be geared towards this greater all encompassing goal: simplify! Make things that appear impossible and complex reachable and achievable; do that by working on your perceptions, on identifying, refocusing and channeling your sense of fear and uncertainty. Being a rebel means, above all, to have the courage to know oneself, what we really care for and value beyond all what society defines as important and relevant. Learning to recognize the own values and putting them into practice at work becomes the fuel of the rebel's energy. The rebel faces with focus and determination the barriers that she comes to recognize either slow down or block the expression of the mix of vision, passion, instincts and agility.

Conley makes a very interesting connection by relating all of this to a key finding by James Collins and Jerry Porras that studied several American companies for their book `Built to Last: Successful Habits of Visionary Companies' "It is better to understand who you are than where you're going in today's unpredictable world - for where you are going will almost certainly change... The crucial variable is not the content of a company's ideology, but how deeply it believes and expresses it in all that it does".The book is rich of practical ideas and examples on how to achieve this. Action, real action "rebels work hard and play hard" is the common denominator of the rebel's aptitudes.

        Do companies need rebels?

This question comes to mind while reading this book. Companies need rebels if they start to realize that they are struggling to keep up with the changes happening in markets and society and mostly if they come to realize that the competitive edge is not simply in keeping up with the changes but trying to lead them! Fostering a culture of rebels, according to Conley's ideas and practices, requires a strong determination to truly engage in a positive and constructive way the experiences, thoughts, passions and observations of the people. Managing a company made of rebels it is certainly much tougher than managing a company made of people whom main goal is just to fit in within the "system" at keep it running; at the same time it can very well be the only long term way forward to survival and success.

4 out of 5 stars Insight to better your business........2006-02-15

Bought this book in 2001 and refereed to it on many occasions in my endeavours. I thought the vision and how to be able to apply it was really insightful. At the time I think you can use this book relatively easily although now it might not be as easy to implement all the author is writing about. Using this book as a guideline to help and get your vision together would be good.
Implementation wise it would be a little more difficult.
        Enjoy!

5 out of 5 stars Great Rebel Book!.......2001-11-28

I bought this book when I was traveling in New Mexico.
It is full of spirit and joy! Read this book!

To be a rebel means to be true to your vision. Chip gives
many examples in his book. Chip is very conscious of how important vision is. Vision gives your life full-throttle power!!! Chip gives you the tools to craft your
        vision magnificiently!

Read this book, and you will be a rebel in life, wherever you are- New Mexico or Maine or Iowa! I think this book applies to
you whether you running a biz, investing, or thinking about starting a very visionary biz! Yes!!!

5 out of 5 stars Today you have to be a rebel!.......2001-10-11

It seems like the world has turned upside down. No wonder business rebels are succeeding like never before - they break with the conventional wisdom and create a whole new paradigm. THE REBEL RULES does a good job explaining who these people are, like Southwest Airlines' Herb Kelleher and Charles Schwab, but more importantly, it helps get inside the head of an entrepreneur. Most business books are written by consultants, so this book is a breath of fresh air as it gives specific tools and strategies that you can immediately use in your company. My only criticism is that the book tries to cover a little too much ground...I would have preferred to see more in-depth discussions in the area of "how to create buzz" or "creating corporate culture" as those seem to be the areas where Mr. Conley excels the most. I highly recommend this book for anyone trying to understand where the world of business is going.

1 out of 5 stars How about the real rebels?.......2001-06-01

I have worked for myself for the last nine years and believe that any true rebels would and should through this book out the window.

I work in a college career center in the Orlando Metro area and this book is one of the most valuable resources that is available for our students who want to find a job locally. My only wish is that a new edition, which would include all available websites, be published now.

              Book Description

Only half of working Americans admit they have thought about saving for retirement, and many of those who do try to save don't know whether they are setting aside enough. How, then, can employees, their employers, and the public sector boost old-age financial security? The contributors to this volume--economists, financial advisers, and housing and benefits specialists--argue that a strong retirement income system requires attention not only to assets conventionally dedicated to retirement purposes, such as pensions, but also to the broader determinants of retiree wealth including housing, health, longevity, and intellectual capital.

This book proposes fresh approaches, including cash-balance pension plans, reverse-annuity mortgages, inflation-indexed bonds, and long-term care insurance. A framework chapter sets the stage by examining what retirement planning can be expected to accomplish and how planning reduces risks by hedging, insuring, and diversifying.

              5 out of 5 stars Book Overview.......2002-07-01

Only half of working Americans admit they have thought about saving for retirement, and many of those who do try to save, don't know if they are setting aside enough to support themselves in old age. How, then, can employees, their employers, and the public sector boost old-age financial security? The contributors to this volume--economists, financial advisers, and housing and benefits specialists --argue that a strong retirement income system requires attention not only to assets conventionally dedicated to retirement purposes such as pensions, but also to the broader determinants of retiree wealth including housing, health, longevity, and intellectual capital.

This book outlines key problems involved in reducing financial risks in retirement, and then it goes on to propose fresh solutions. These include cash-balance pension plans that combine features of traditional defined benefit pensions and increasingly popular defined contribution plans. Other novel approaches discussed include reverse-annuity mortgages permitting people to benefit from the value of their homes without actually selling them, various forms of annuities, and long-term care insurance. A framework chapter sets the stage by examining what retirement planning can be expected to accomplish and how planning reduces risks by hedging, insuring, and diversifying. This book should be required reading for all who seek to strengthen retirement decision-making and old age protection.
